Just when we thought Brain Laundrie’s legacy couldn’t get any darker or more sinister, it does.

Brian’s parents, Chris and Roberta Laundrie, are now working to dismiss the lawsuit brought by the late-Gabby Petito’s parents, Joseph Petito and Nichole Schmidt.

Earlier this month, we reported on Petito and Schmidt filing a lawsuit against the murderer’s parents.

On March 11, Gabby’s biological parents filed a lawsuit at a Florida court suing Chris and Roberta for knowing more about their daughter’s death than they let on.

Chris and Roberta’s lawyer, Steven Bertolino, made a statement to CBS News on March 30.

“A motion to dismiss the baseless and frivolous lawsuit commenced by Gabby Petito's parents was filed in court,” Bertolino said in the statement. "The Laundries have exercised their constitutional right to refrain from speaking and have relied on counsel to speak for them. This is not only common practice in our civilized society but it embodies the exercise of fundamental rights under the United States and Florida Constitutions. The Laundries' rights are inalienable and the Laundries can never be liable for exercising their legal rights in a permissible way."

Gabby’s life was cut short at 22-years-old at the hands of her fiancé. Her body was found in the Grand Teton National Park in Wyoming last September.

Her official cause of death was “blunt force injuries to the head and neck, with manual strangulation.”

Brian confessed to killing his significant other in a notebook entry that was found near his remains in a Florida nature reserve.Petito and Schmidt’s lawsuit claims Chris and Roberta knew that Brian had killed Gabby before returning home in her white camper van without her.

Gabby’s parents also claim Chris and Roberta were conspiring with Brian to keep him hidden, and conceal his alleged confession from the authorities and the Petito-Schmidt families.

"In doing so, Christopher Laundrie and Roberta Laundrie acted with malice or great indifference to the rights of [Petito's parents] Joseph Petito and Nicole Schmidt," the lawsuit claims, adding that their alleged conduct was "shocking, atrocious, and utterly intolerable in a civilized community."

Petito and Schmidt also believe Chris and Roberta were arranging to help Brian flee the country; however, there was no hard evidence to back up this claim.

The lawsuit seeks damages of at least $30,000.00.

According to the Petito’s lawsuit, the relationship between the two families was “cordial,” but turned sour after Gabby had gone missing.

Nichole Schmidt claims Roberta blocked her cell phone number and Facebook profile after things worsened.

Earlier this year, the FBI revealed the disturbing evidence found in Brian’s notebook.

As previously mentioned, Brian admitted to killing his fiancée in a notebook entry he wrote shortly before his took his own life.

The murderer also sent text messages from Gabby’s phone to her parents in the days after her death.

This was his attempt “to deceive law enforcement by giving the impression Ms. Petito was still alive,” the FBI Denver said in its final investigative update.

FBI Denver also revealed that Gabby’s parents met with the FBI at the Tampa Field Office on Thursday, January 20.

“All logical investigative steps have been concluded in this case,” said FBI Denver Division Special Agent in Charge Michael Schneider. “The investigation did not identify any other individuals other than Brian Laundrie directly involved in the tragic death of Gabby Petito. The FBI’s primary focus throughout the investigation was to bring justice to Gabby and her family. The public’s role in helping us in this endeavor was invaluable as the investigation was covered in the media around the world. On behalf of the FBI, I want to express my deepest appreciation to the public for the thousands of tips that were provided during the investigation, and to our local, state and federal law enforcement partners for their work throughout the investigation.”

The FBI opened its investigation into the disappearance of Gabby on September 12 after her mother reported her missing on September 11.
