
Tiffany Haddish‘s DUI drama doesn’t appear to have an end in sight after four years.
The actress was arrested in January 2022 in Peachtree City after falling asleep behind the wheel. Although she regained her freedom after posting bail, the case never went to trial.

Prosecutors Are Against The Dismissal Of Tiffany Haddish’s DUI Case

According to new reports, prosecutors have responded to Haddish’s petition to dismiss the DUI case. The State of Georgia urged the judge to reject the entertainer’s request, arguing that the four-year delay in the proceedings had done her little to no harm.
The court documents saw prosecutors accepting responsibility for the delays, as Haddish pointed out in her dismissal request. However, the State of Georgia explained that these setbacks were unintentional and shouldn’t be used as grounds to dismiss the DUI case.
The prosecutors, per TMZ, mostly focused on Haddish’s claims for damages, arguing that the court had only her word. The actress had claimed the delayed case had damaged her career and limited her ability to travel internationally, but the State noted there was no proof of these claims.

Besides calling out Haddish’s lack of evidence, prosecutors also argued that she had no reason to complain. The State believed Haddish hadn’t suffered over the years because of the delayed proceedings and her release on bail.
They stressed that Haddish was free and not behind bars during the four-year delay, allowing her to live quite comfortably. As for Haddish’s claims over the years that she was ready for court, prosecutors called BS, saying she had never requested an immediate trial.
Haddish’s tales of anxiety and stress were similarly shut down, with prosecutors claiming her concerns weren’t uncommon. The State explained that those in criminal cases faced emotional distress, and these feelings alone could not justify a dismissal.

Haddish’s petition to dismiss the DUI case first made waves in May. The Blast covered the story, reporting that the actress’s lawyers had filed to have the charges dismissed on the grounds of time elapsed, given the four-year delay.
The legal reps argued that Haddish’s constitutional right to a speedy trial had been breached by prosecutors, whom they blamed solely for the delays. Haddish’s lawyers noted that the prosecutors filed motions to continue the case twice last year, yet the case remained at a standstill.
Haddish’s team revealed the case only moved forward two years ago after they filed a motion to suppress. A hearing on that motion was held on May 2, 2024, but the court has not entered any orders since then. Additionally, Haddish’s reps claimed they declared themselves “ready for trial” on at least 10 occasions.
The Actress Earned A Small Victory In The Case

Haddish’s complaints continued, claiming she lost business opportunities due to the delayed case. Her lawyers explained that the case created complications when Haddish tried to obtain travel clearances to film in Australia. The setback allegedly cost extra funds to resolve.
Haddish’s motion for dismissal remains open, but she has earned a small victory in the DUI case. The Blast shared in May that a judge had accepted Haddish’s plea to suppress a field sobriety test and several statements recorded by the police for being admitted as evidence.
The judge ruled that the field sobriety test was conducted poorly, without consideration of Haddish’s lazy eye, even though she had informed the police officer. Additionally, several statements she made during the arrest were dismissed because the officer didn’t read her Miranda rights.

A year after the 2022 incident, Haddish was arrested a second time on a DUI charge after she was found unconscious behind the wheel. She faced the music for the crime, pleading no contest to reckless driving charges, and was sentenced to one year of summary probation.
Haddish was also ordered to complete 40 hours of community service, pay standard court fines and fees, and enroll in several court-mandated programs. The punishment seemed to have been the wake-up call Haddish needed as she embraced sobriety.
When asked how she felt staying clear of marijuana and alcohol as the court ordered, Haddish claimed she did not indulge in these vices without good reason. According to the TV personality, she used marijuana to cope with the painful symptoms of her endometriosis.
