Judge John W. Ouderkirk originally granted Pitt joint custody of the couple's five children in May 2021. However, Jolie appealed the decision.
A California appeals court disqualified Ouderkirk because it found that he did not adequately disclose business relationships with Pitt's attorneys.
Ouderkirk declined to disqualify himself when Jolie asked him to in 2020. The appeals court recently ruled in her favor, and his joint custody decision was made null.
In Brad's new legal filing, he claims that any error made by Ouderkirk was "minor" and not a valid reason to vacate the actual custody ruling.
Pitt and his team are claiming that Jolie was just looking for any reason to get the judge tossed off the case.
