According to legal documents, filed by the ‘Once Upon A Time…In Hollywood’ star, Angelina shouldn’t have gotten custody of the couple’s children due to a measly administrative error by a temporary judge. It’s a bit confusing, but as we reported, Pitt was originally granted joint custody of the couple’s five children by Judge John W. Ouderkirk.
Fast forward, Angelina challenged the ruling and won in the appeals court — which decided to disqualify Ouderkirk — fining he did not adequately disclose matters involving Pitt he had presided over. As we reported, the judge declined to disqualify himself from the divorce, even though he had a long relationship with the family, including presiding over their marriage ceremony.

In Brad Pitt’s new filing, he says that any error made by Ouderkirk was “minor” and not worth vacating the actual custody ruling. Plus, he claims Angelina was looking for any reason to get him tossed out of the case.
Remember, Brad Pitt lost custody of his children after the actress accused him of child abuse. In a highly publicized incident, Brad argued with the couple’s son — Maddox — and reportedly stuck the child during the incident. It should be noted, law enforcement investigated the situation and cleared Brad Pitt of any wrongdoing.
“We are seeking review in the California Supreme Court because the temporary judge, who had been appointed and repeatedly renewed by both sides, was improperly disqualified after providing a detailed, fact-based custodial decision, following a lengthy legal process with multiple witnesses and experts,” Brad’s lawyer told PageSix.

They continued, “The lower court’s ruling will reward parties who are losing child custody cases, and condone their gamesmanship, by allowing them to wait and see about the likely direction of the case before seeking the disqualification of the judge.”
Adding, “Condoning the use of this type of strategic ‘lie in wait’ disqualification challenge will cause irreparable harm to both the children and families involved in this case, and other families in other cases, by unnecessarily prolonging the resolution of these disputes in an already overburdened court system. Allowing this kind of crafty litigation strategy will deprive parents of irreplaceable time with their children as judges are disqualified for minor reasons in the midst of their cases.”
