The wife of legendary comedian Tim Conway claims his daughter violated his medical privacy and relied on a false medical report in her effort to assume control over his medical treatment.
According to court documents obtained by The Blast, Charlene Conway claims it is "deeply concerning" that Kelly Conway was able to bypass HIPAA laws and breached Conway's medical privacy in certain reports Kelly filed in her attempt to be named conservator over her father.
Charlene claims there is no record at the medical facility where Tim Conway stays of the doctor Kelly used to examine Conway ever signing in to the facility. She claims the doctor "surreptitiously" entered the facility and "intentionally did not sign in or announce the reason for his visit."
In addition, Charlene claims Kelly purposely picked a day for the examination when she knew Charlene would not be there.
In the documents, Charlene claims the doctor's report "was, for the most part, based entirely on conjecture and fabricated 'facts' provided by Kelly." She says if the report was really trying to be independent, the doctor would have "interviewed the one person who would know Tim's issues best: his wife of 34 years, Charlene."
She says the doctor's report contains "highly confidential" medical information that the doctor could not have had access to without Charlene's consent.
Charlene also takes issue with Kelly's suggestion that Charlene is moving Tim from his current medical facility. She says she has "no intention of moving her husband from his current care provider" and for that reason, Kelly's attempt at conservatorship and her request for a temporary restraining order should be denied.
The case remains ongoing.
