Prosecutors Move to Dismiss Child Porn Case Against Mark Salling

Following his suicide, prosecutors have filed a motion to dismiss the child pornography case against "Glee" star Mark Salling ... but they are oddly leaving the window open to re-file the case.

The United States Attorney for the Central District of California filed documents on Monday to dismiss the indictment against Salling, who had agreed last October to plead guilty to possession of child pornography involving a prepubescent minor.

In the documents, the U.S. Attorney says they wish to dismiss the case "without prejudice," meaning they can file the case again if they choose. As a footnote, they state the following reason: "While the government has not reviewed official documentation, it has been reliably informed and believes that defendant Salling is deceased."

Salling was due to be sentenced in March, but he committed suicide on January 30.
