'RHOA' Star Kenya Moore Demands Full Custody Of Daughter Over 'Safety' Issues In Ongoing Divorce!

Kenya Moore has filed for divorce from her husband, Marc Daly, and the reality star is asking for sole physical and legal custody of their 2-year old daughter, Brooklyn.

According to new legal documents, the 'Real Housewives Of Atlanta' star filed for dissolution of marriage in Fulton County, Georgia. In the filing, Moore is asking for full custody of the couple's 2-year old daughter. On one hand, she is asking for the child to physically live with her, and also permission to make all major decisions for the child including medical and schooling.

The 'RHOA' star's husband has reportedly agreed to allow her to maintain primary physical custody of the minor child, but in Daly's response to the divorce, he is asking to have joint legal custody of their daughter to be able to make the important decisions.

In the documents, obtained by RadarOnline, Moore and Daly have been living in a "bonafide state of separation" since September of 2019, and she says the marriage is "irretrievably broken and can not be reconciled."

No Prenuptial Agreement In Kenya Moore's Divorce?!

"The parties have acquired other joint personal property as a result of their marriage by way of gifts or joint purchases which must be equitably divided as well as marital debt which must be equitably divided," Moore states in the filing. In other words, it doesn't appear the couple has a prenuptial agreement, and whatever they have acquired over the years would be split in half.

Plus, if Daly is agreeing to Moore's request to have sole physical custody of their daughter, he will most likely be forced to pay considerable child support to his ex-wife. Interestingly, in his response, Daly is asking the court to award him "separate real and personal property." In other words, there might be a fight brewing over the finances in this case!

Following the initial split, Moore sat down with Andy Cohen in February of 2020, where she described their ongoing relationship. "We're in a good place right now. We're trying to figure it out," she said. In March, she kept the positivity going saying the couple is "good."

'RHOA' Star's Marriage Is 'Irretrievably Broken'

"It does, because emotions are really high, Andy, and I've never been through a divorce," she said. Adding, "I've never had a separation. I've never had a child with anyone, so all of these things are new for me."

"With Marc, I think, you know, he's still in love. I still have love for Marc. We are just in a very difficult place, and no one wants to really pull the trigger. But I had to do what was best for Brooklyn for right now because I am her primary custodial parent."

The good news is the ex-couple appears to be co-parenting the child perfectly after vacationing together over the summer and smiling for a family photo. "Happy Father's Day Marc!" she wrote on IG. Adding, "Brookie loves you so much, and watching you two together and witnessing the undeniable bond you have makes my heart so full. Thank you for my miracle baby. You will forever be our family and we love you so much!"
