Will Smith‘s ex-violinist was left disappointed after the judge’s ruling on his sexual harassment case.

Brian King Joseph, who gained recognition in the industry as a top three finalist on “America’s Got Talent” in 2018, sued the iconic actor for wrongful termination and claims of sexual harassment over an alleged incident that took place in 2025.

The case came to light after the music prodigy went on tour with Will Smith last year. The actor’s legal team has since pushed back at the scathing allegations, tagging them false and baseless.

Smith got his wishes granted as a judge has tossed out the sexual harassment lawsuit filed against him. Joseph brought the claims to the spotlight after suing the rapper a few months back for sexual harassment and wrongful termination regarding an alleged incident in 2025. He claimed that Smith was grooming and priming him for sexual activity.

TMZ obtained a copy of the judge’s ruling from Tuesday, May 5, which detailed the reasons the case did not hold up in court. The judge stated that the violin prodigy’s suit does not qualify as sexual harassment as it “fails to adequately allege conduct that is sufficiently severe or pervasive.” 

Joseph alleged in his filing that Smith had left a note and other supplies in his room. The judge also addressed the claims, stating that the plaintiff had not sufficiently pled facts that the only other people with access to his hotel room were the actor or his management.

Based on the instrumentalist’s statement that he left his bag with his room key in a van with other crew members for a few hours, he could not disprove that others did not have access to his room during that time frame. The judge, however, gave Joseph an opportunity to amend his complaint and try to fix the problems that got the case dismissed.

Inside The Violinist’s Allegations Against The Actor

The violinist claimed that while he was on tour with the rapper last year, someone entered his Las Vegas hotel room in his absence and left him wipes, beer, and HIV meds along with a note that read “Brian, I’ll be back … just us,” which was signed “Stone F.” He said that the items were rather strange and left him worried that a strange person would try to enter his room later in the evening.

He claims that working with the entertainer had transcended beyond a normal working relationship as they spent a lot of time together. Joseph alleged that Smith had told him during their time together that they shared a special relationship he does not have with anybody else. 

The “America’s Got Talent” finalist claims that he was sacked from Smith’s Vegas tour team after reporting the incident. “Getting fired or getting blamed or shamed or threatened or anything like that simply for reporting sexual misconduct or safety threats at work is not okay,” Joseph previously noted on social media.

The actor’s legal team addressed the violinist’s claims, slamming them as a medium for extortion, as shared by The Blast. Attorney Allen B. Grodsky released a statement denying the allegations on behalf of his client, Smith, before stating that they were “false, baseless, and reckless.”

Grodsky stressed that the team will explore all legal means to address the claims and pursue the truth. He pointed out that Joseph had admitted to not knowing who the mystery “Stone F” in his letter is, hence he had no evidence tying the letter to Smith, but still went ahead to file the lawsuit.

Smith’s attorney also expressed that he hoped the judge would grant their motion to strike the case against the rapper and his company, Treyball Studios, while pointing out other inconsistencies with the allegations. Grodsky explained that Joseph and Smith were never alone together, and it remained unclear what he meant by the musician grooming him.  

Addressing the accusation of wrongful termination, the “Bad Boys” actor’s lawyer explained that Joseph was not invited to join the tour but was hired only on a per-show basis and was never promised any position in the band. Joseph reportedly acted erratically on tour, proved difficult to work with, and made others uncomfortable.

After the viral incident where Smith slapped Chris Rock at the 2022 Oscars, he was banned from attending the Academy Awards and retreated into a low-key life status. The actor later apologized in a statement, saying he “reacted emotionally” as a result of the joke Rock made about his wife Jada Pinkett Smith’s hair loss condition, alopecia.

A month after the slapping incident, it was reported that Smith retreated to India, where he practiced yoga and meditation. Last year, the Grammy winner made his comeback to music by releasing his first full-length album in two decades, “Based on a True Story.”

In the track, he addressed the infamous slap incident in the first song on the album. The song opens with the line, “Will Smith is canceled,” and in another verse, he raps, “He and Jada both crazy, girl, what you talkin’ about? / You better keep his wife’s name out of your mouth.”

According to Page Six, Smith sought advice from other A-list stars in the music industry while he was putting the project together. He reached out to Jay-Z and Kendrick Lamar, who urged him to speak his truth and say things he had “always been f-cking scared to say.” Smith also marked his comeback to TV screens, starring in “Bad Boys: Ride or Die.”

In line with this project, the rapper traveled to Luanda, Angola, where he was welcomed at the presidential palace. He met with Angola’s President Joao Lourenco and was joined by E1 Series President Alejandro Agag. The trip marked a milestone in the expansion of the E1 World Electric Boat Championship as they announced that Luanada will officially join the league.

Angola is already known for competitive sailing, and the actor’s hand in merging the all-electric racing world in the region marked a big step forward for the sport. Smith also launched his own E1 league team two years ago. He has since made moves to push Team Westbrook onto the international stage.
