Alo could face potential legal trouble after a staff member allegedly leaked Erika Kirk‘s shopping history to a TikToker.
The information was shared in a viral post from the social media influencer, revealing that the mother of two shopped at the clothing brand less than 24 hours after the death of her husband, Charlie Kirk.
The allegations against Erika Kirk have since been refuted by TPUSA staffer Elizabeth McCoy, who stated that she was the one who purchased the clothes as a matter of urgency.
The Widow Was Accused Of Spending Over $1,000 At Alo Hours After Her Husband’s Death

Allegations that Erika shopped shortly after her husband’s death were made by a TikToker, who claimed to have received the information from an anonymous Alo staff member.
In the viral post, the influencer shared what appeared to be a receipt of the mother of two’s shopping history, indicating that Erika spent just over $1,000 at the store on the alleged date.
The TikToker further claimed that she purchased several all-black outfits and described them as “extremely, extremely overpriced” items.
The post also took a swipe at the TPUSA CEO, questioning how appropriate it was for her to go shopping so soon after her husband’s death.
“I don’t even know what’s more egregious to me. The fact that she went on a shopping spree not even 24 hours after her husband was publicly assassinated, or the fact that she shops at Alo?” remarked the influencer.
“That is not how shock works. That is not how grief works for a normal person,” the TikToker further remarked, “No one’s wearing leggings and a sports bra to their husband’s funeral.”
TPUSA Staffer Reveals Erika Kirk Wasn’t The One Who Shopped At Alo

Shortly after the TikTok post went viral, a TPUSA staffer named Elizabeth McCoy came out to clarify that Erika was not the one who shopped at the clothing brand.
“I was the one who made the Alo purchase, in person, in Utah,” the individual revealed. “When we got the call that Charlie had been shot, we rushed from the office and into the airplane. We arrived in Utah with nothing but the clothes we were wearing. We were in those clothes all day at the hospital and slept in them that night. “
She added, “The next morning, our friend Stacy handed me her card, and I went out and picked up some items and toiletries for various team members and Erika. Alo was down the street.”
The TPUSA staffer went on to call the allegations against Erika a “planned, manufactured attack” and slammed those who were propagating the claims as “cruel and vicious.”
Can Erika Kirk Take Legal Actions Against The Clothing Brand?
In the wake of Erika being accused of shopping at Alo less than 24 hours after her husband’s death, a legal expert weighed in on whether the mother of two can take legal action against the clothing brand over the leak of her shopping history.
Speaking with Fox News Digital, attorney Danny Karon revealed that retail stores like Alo cannot freely disclose a customer’s purchasing history.
He explained that this depends on factors such as how the data is used, who it is shared with, and which state’s laws apply.
Expert Says The Release Of The Widow’s Shopping History Was A ‘Privacy Breach’

Regarding Erika’s case specifically, attorney Danny Karon described the leak of her shopping history as a “privacy breach” and stated that Alo may not be protected from being sued under the Utah Consumer Privacy Act (UCPA).
“Even though Kirk is not a Utah resident, because her Alo purchase occurred in a Utah brick-and-mortar location and the disclosure occurred in Utah, personal jurisdiction over the parties exists in Utah, as does the application of Utah law,” Karon noted.
“This means she may file her case in Utah under Utah law,” the legal expert added.
Erika Kirk Has Yet To Comment On The Allegations

Despite the clarification from the TPUSA staffer, attention on the alleged shopping spree remains for now.
Meanwhile, Erika herself has yet to comment and appears to be ignoring the allegations, as she has done with much of the scrutiny she has faced in recent months.
As for the Alo brand, it has yet to release a statement regarding the situation, particularly on whether it has identified the staff member who allegedly leaked the information and if it intends to take any action.
