Why Charlie Kirk's Alleged Shooter's Lawyers Want Video Of The Murder Blocked As Evidence

Tyler Robinson's attorneys have filed a motion seeking to block video footage of Charlie Kirk's alleged murder from being introduced by prosecutors at an upcoming hearing.
The move is the latest effort by the defense to have prosecutors removed from the case, citing what they claim is a conflict of interest that could lead to bias against the accused.
Tyler Robinson is accused of assassinating right-wing influencer Charlie Kirk, who was shot at an event for his nonprofit organization, Turning Point USA, last September.
The Attorneys Said The Charlie Kirk Video Will Negatively Impact Tyler Robinson's Right To A Fair Trial

Ahead of a February 3 hearing in the Charlie Kirk murder case, attorneys for Tyler Robinson filed a memorandum on Tuesday seeking to block video footage of the incident from being introduced during the upcoming proceedings.
In the filing obtained by Fox News Digital, Robinson's attorneys outlined several reasons why introducing the video would be unnecessary.
One argument stated that the footage is "of no probative value to any material issues" surrounding their earlier motion to have the county prosecutor's office disqualified from handling the case.
They further argued that even if prosecutors claim the evidence holds some probative value, it is "substantially outweighed by the danger of unfair prejudice" to Robinson and would also infringe upon his right to a fair trial.
In support of this claim, the defense cited the fact that the court has yet to rule on a separate motion to prohibit recordings during court proceedings.
As a result, they argue that allowing the video to be shown at the upcoming hearing could lead to the very bias they say would unfairly prejudice the accused.
Experts Believe Tyler Robinson's Lawyers Are Right To File The Memorandum

At the moment, it is unclear which video of the murder the prosecutors plan to introduce, whether it is an original recording or one of the many viral videos that surfaced online after the incident.
However, experts believe the defense's effort to block the introduction of the evidence was a strategic and prudent move.
"This is a solid argument," said Chicago-based criminal defense attorney Donna Rotunno.
"The video should not be played if it isn't needed to prove any material issues in the hearing," the Fox contributor added. "I do not see how it is needed to determine if the prosecution should be disqualified."
Skye Lazaro, a Salt Lake City–based criminal defense attorney, also supported Rotunno's stance on the matter. However, she acknowledged that the judge could rule in either direction.
"I'm not sure they're going to be successful there," she told the outlet.
Expert Previously Called On The Judge To Curb The Defense's Alleged Delayed Tactics

Despite being arrested last September, Robinson has yet to enter a plea to the seven charges filed against him, including aggravated murder.
This important process in the proceedings appears to have been delayed by continued motions from the defense, including the effort to remove the prosecutor.
As a result, some experts are calling on Judge Tony Graf Jr. to take action and curb what they see as deliberate delay tactics.
"The judge has let it go on too far," Rotunno told Fox News Digital. "This is something that the judge could've looked at in writing and said, 'You know what? No need for a hearing.'"
"The judge needs to toughen up," David Gelman, a Philadelphia-area defense attorney and legal analyst, added. "It's only going to get worse if he doesn't rein in the attorneys."
Charlie Kirk's Wife Recently Filed For The Speedy Trial Of Tyler Robinson

Recently, Erika Kirk, the wife of Charlie Kirk, added her voice to calls for a speedy trial for her husband's alleged killer.
Through her lawyer, she filed a motion citing Utah law, which allows victims to request a speedy trial in such cases.
"The Utah Code affords victims of a crime 'the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant,'" read the filing by Erika's attorney, Jeffrey Neiman.
It read further, "This Court is tasked with the critically important function of ensuring the Defendant has a fair trial, but this Court must also do so while balancing Mrs. Kirk's right to a speedy trial, and therefore this Notice invokes Mrs. Kirk's rights under applicable Utah Code."
Charlie Kirk's Alleged Killer Could Get The Death Penalty

Robinson was charged with aggravated murder, felony discharge of a firearm, and committing a violent offense in the presence of a child.
The alleged shooter of the right-wing influencer has also been charged with two counts of obstruction of justice and two counts of witness tampering.
If found guilty, Robinson risks being hit with the death penalty, which prosecutors intend to seek.
