The stuntwoman who worked on "Horizon: An American Saga – Chapter 2" has filed an amended lawsuit accusing Kevin Costner and the film’s producers of exposing her to an unscripted, unchoreographed sexual assault scene.
Devyn LaBella claims she suffered humiliation and emotional distress during the shoot.
Costner’s legal team has forcefully denied the allegations, calling the lawsuit meritless and unsupported by witnesses.

Stunt performer Devyn LaBella claims she was thrust into a distressing and unscripted rape scene during the filming of "Horizon: An American Saga – Chapter 2."
In court documents filed on June 18 in Los Angeles and obtained by PEOPLE Magazine, LaBella’s attorneys stated that the controversial scene took place on May 2, 2023, and was executed without the presence of a stunt or intimacy coordinator.
She alleged that Costner instructed her to "lay down" while fellow actor Roger Ivens, "dirty and covered in sweat," pinned her legs and lifted her skirt.
Her complaint stated she was never given a chance to prepare for the scene or consent to it.
"Ms. LaBella was never given the opportunity to prepare for or consent to participate in this scene, much less to object to it," her legal team wrote.
The complaint also noted that Ivens “never separated” from LaBella between takes, leaving her unsure when the scene was actively being filmed.

LaBella’s amended complaint went further, alleging that her "personal undergarments were exposed" during the scene, an ordeal intensified by the fact that she was menstruating.
The complaint described the moment as “especially humiliating,” adding that Ivens' hands rested “on top of the bundled-up skirt above her vagina” between takes.
After the scene, she claims she was left alone in a wagon, emotionally shaken.
"She experienced shock, embarrassment and humiliation while attempting to process the situation," the documents stated.
Kevin Costner’s Team Denies Sexual Nature Of The Scene

In response to the lawsuit, Costner’s attorney Marty Singer issued a strong denial.
"Ms. LaBella was doing a rehearsal on an Insert Shot for a scripted scene," he said. "There was no intimacy or anything sexual in the shot. There was tugging on a dress while she was fully clothed in a dress with long bloomers lying down next to a male actor."
Singer also emphasized that LaBella had expressed gratitude after filming.
He claimed, “She herself texted her supervisor after she wrapped stating, ‘Thank you for these wonderful weeks.’”
Singer dismissed the lawsuit as baseless and predicted it would be swiftly thrown out.
“Numerous witnesses have contradicted Ms. LaBella’s meritless claims. We look forward to the swift end of this specious lawsuit,” he noted.
Stunt Performer Adds Text Messages To Strengthen Case Against Costner

Earlier, TMZ reported that Devyn LaBella had included new evidence in her sexual assault lawsuit against Costner, intensifying her legal battle against him.
Her amended complaint now includes a series of messages she claims to have sent to the film’s intimacy coordinator.
LaBella’s revised filing targets Costner and other producers involved in the film. The new evidence centers around messages exchanged with intimacy coordinator Celeste Cheney, specifically referencing the disturbing incident that prompted the suit.
In one message sent a day after the shoot, LaBella wrote, "I wanted to discuss yesterday's abomination when we both have a chance ... I was put in a really wrong position and it's really affected me."
She also questioned why Cheney was absent during such a sensitive shoot and demanded clarification on why she was “forced to do non-stunt work, especially given the sensitivity of it.”

Devyn LaBella first filed the sexual harassment lawsuit against Costner and the producers of "Horizon: An American Saga – Chapter 2" in May.
She alleged that she was forced into a “violent, unscripted, unscheduled rape scene” without consent or preparation.
According to LaBella, she was told to step in after lead actress Ella Hunt refused to shoot the scene, which involved a second actor climbing on top of her and lifting her skirt.
She claimed no “action” or “cut” was called, and no intimacy coordinator was present.
LaBella also claimed that she began therapy, adding that the incident left lasting emotional damage.
Costner’s attorney, Marty Singer, denied the allegations, calling LaBella a “serial accuser” and claiming she had approved and rehearsed the scene.
