Nipsey Hussle's ex-girlfriend, Tanisha Foster, has hit a roadblock in her ongoing legal battle with his family.

A judge has denied Tanisha's request to question the late rapper's brother, Sam Asghedom, just weeks before their court battle over the guardianship of her daughter, Emani, starts.

This legal fight has been brewing for some time. Tanisha Foster's latest legal move was part of her effort to terminate the guardianship arrangement, which has been in place since Nipsey Hussle's death.

Tanisha hit another obstacle as a Los Angeles Superior Court judge denied her urgent request to depose Nipsey's brother. Court documents reveal that the judge ruled against Tanisha's petition, stating:

"The Court finds that insufficient evidence has been provided to grant the matter on the calendar this date based upon the reading of the moving papers and consideration of all presented evidence."

In Touch reports that this legal dispute has been dragging on for over a year, with most filings heavily redacted. Since Nipsey's tragic passing at age 33 on March 31, 2019, his family has been serving as Emani's co-guardians, a decision Tanisha has been fighting to overturn.

After months of legal back-and-forth, the case is set to reach a boiling point.The trial will determine Emani's guardianship and is scheduled for February 25.

Tanisha's legal battle over the guardianship of her daughter, Emani, has been brewing for years. Back in 2022, she filed a petition to terminate the guardianship.

The mother-of-one admitted that she initially agreed to let Nipsey's family take guardianship of Emani after his tragic passing, believing it was in her daughter's best interest at the time. 

According to court filings, her decision was based on her financial struggles and a desire to maintain the stable lifestyle their daughter had before the artist's death. She also claimed she was verbally assured that his family would act in her daughter's best interests.

However, Tanisha now argued that those promises were broken. She accused Nipsey's family of using their wealth and influence to limit both her visitation and financial support, ultimately making it harder for her to be present in Emani's life. Tanisha reportedly wrote in her petition:

"There are no circumstances or events in my life that would disqualify me for regaining my exclusive role as Emani's parent. Emani routinely asks me when are she and I going to be able to live together. She longs to be with me as her mother. I am begging the court to terminate the existing guardianship."

Tanisha took bold steps in her ongoing fight for custody of her daughter. ICYMI, The Blast reported that earlier this month, she filed an urgent request to have Nipsey's brother testify, claiming his deposition is crucial to her case.

Her objective? To strengthen her argument ahead of the February 25 trial, where she hopes to overturn the guardianship arrangement that has kept Emani under Nipsey's family's care since 2019.

On February 4, Tanisha submitted an official application requesting Sam's testimony, pushing for a deposition the following week. Since Nipsey's tragic passing, his estate has been managed by Sam, his sister Samantha Smith, and their mother, Angelique Smith.

The fight over Nipsey's daughter has been ongoing, with his family standing firm in their belief that she belongs in their care. They have argued that providing Emani with stability is their top priority from the start.

Nipsey's sister, Samantha, petitioned to become Emani's legal guardian on behalf of the family, raising concerns about Tanisha's ability to parent effectively.

In her filing, Samantha emphasized her deep commitment to Emani's well-being, stressing the importance of keeping her connected to Nipsey's side of the family and ensuring she remains in a secure and stable home environment.

Tanisha initially fought against the guardianship request, but despite her opposition, the court ruled in favor of Nipsey's family. In October 2019, a judge officially appointed them as Emani's legal guardians.

Tanisha's custody battle for her daughter stands in stark contrast to the situation of Nipsey's second baby mama, Lauren London. Since the tragic loss of the rapper, Lauren seems to have successfully raised their child without any legal hurdles.

The actress, who was Nipsey's partner until his untimely passing, has fully embraced the role of a mother to their child while also raising her 13-year-old son, Kameron Carter, whom she shares with rapper Lil Wayne.

Despite the pain of losing her partner, Lauren has consistently honored Nipsey's legacy, keeping his memory alive for their children. In 2023, Lauren shared a heartfelt tribute on Instagram to mark Nipsey's posthumous 38th birthday.
