Sean "Diddy" Combs' legal team filed a motion comparing his case to Donald Trump's legal battles, arguing for his release before Thanksgiving.
They cited free speech protections and claimed that the rapper's constitutional rights were violated. This came after accusations he used social media to influence potential jurors.
Sean "Diddy" Combs faces federal charges of racketeering, sex trafficking, and transportation to engage in prostitution after his arrest in September.
Diddy's Lawyers Cite Donald Trump Case In Bid For Release, Defend His Right To Speak Out
In a court filing on Monday, Sean "Diddy" Combs' legal team made a controversial comparison between the rapper's case and ex-president Donald Trump's ongoing legal battles in an attempt to secure his release from jail before Thanksgiving.
They referenced a ruling from Trump's election interference case, highlighting the protection of free speech under the First Amendment.
"Only a significant and imminent threat to the administration of criminal justice will support restricting Mr. Trump's speech," the rapper's lawyers noted per the Daily Mail.
They then argued that Diddy has "a greater constitutional claim than other trial participants...to speak out against the prosecution and the criminal trial process that seek to take away his liberty."
The lawyers went on to urge the court to apply "Trump's heightened standard when considering Mr. Combs' speech here."
Diddy's New Bail Package Proposal
Diddy currently faces federal charges, including racketeering, sex trafficking, and transportation for prostitution.
Since the rapper's arrest, he has been locked up at the Brooklyn MDC jail and has also been denied bail on two occasions for posing a flight risk.
Ahead of Thanksgiving Day, Diddy has sought bail again, presenting a comprehensive package that supersedes what he offered in his previous bail attempts.
As part of the package, the music mogul reportedly offered a "$50 million bond secured by the equity in Combs and his mother's Florida homes, implementation of a 24/7 monitoring service by approved security personnel."
According to a report, the rapper also included additional conditions, such as prohibiting himself from having "internet or phone access outside of meetings with legal counsel, a pre-approved visitor list consisting of select family members, and surrendered passports belonging to the rapper and his family members."
The Rapper Was Accused Of Trying To Sway Potential Jurors
The latest legal motion was filed in response to accusations that the "Bad Boy" mogul attempted to sway potential jurors by orchestrating a "public relations campaign" using his children's social media accounts.
The allegation arose from a video posted on November 4, showing Diddy's children celebrating his birthday.
In the clip, his son Justin Dior Combs, 30, along with six other children, including his two-year-old daughter Love, gathered around a birthday cake to sing him "Happy Birthday."
In the background, Diddy's voice could be heard for the first time since his arrest.
The disgraced rapper expressed his love and gratitude, saying: "I love y'all so much. I can't wait to see y'all. I just want to say I'm proud of y'all, especially the girls. I mean all of y'all, but just for being strong."
He added: "Thank y'all for being strong and thank y'all for being by my side, supporting me. I love y'all. I have the best family in the world. My birthday. I'm happy. Thank y'all for giving me this call. I love y'all."
According to Business Insider, Diddy used a prohibited app, ContactMeASAP.com, to arrange for videos featuring his children to be posted online.
Federal Prosecutors Argued Against Diddy's Release On Bail
Ahead of the ruling, federal prosecutors filed a motion that the rapper poses a "serious risk of obstruction, danger, and flight" in a bid to get his fourth bail attempt denied.
They stated that Diddy has attempted to obstruct his sex crimes case by making efforts "to publicly leak materials he views as helpful to his case" and initiating "media campaigns that are, in his own words, aimed at tainting the jury pool."
The filing also alleged that Diddy violated rules prohibiting contact with individuals not on his approved contact list, including witnesses relevant to his case.
To avoid being caught, he reportedly used the telephone accounts of at least eight other inmates. He paid for the access through other inmates using "payment processing apps and BOP (Bureau of Prisons) commissary account deposits."
Additionally, prosecutors claim that while incarcerated, the "Finna Get Loose" rapper made an overwhelming 128 calls and texts over four days to a witness, allegedly attempting to convince her to support him.
The Rapper Claims Feds Edited A Video Of Him Assaulting His Ex To Make It Harder To Get Bail
Prior to Diddy's recent bail hearing last Friday, the rapper's legal team filed new docs in which they accused federal prosecutors of "mischaracterizing and concealing critical facts" to get the rapper's bail request denied.
According to the documents obtained by TMZ, Diddy's lawyers alleged that the prosecutors had shown the presiding judge an edited video of an altercation between Diddy and his ex Cassie, which was caught by the camera in the hotel where it occurred.
The incident occurred in 2016, and the video of it went viral earlier this year amid Diddy being investigated by the authorities.
Diddy's lawyers also claimed that the prosecutors had the unedited version of the video but chose to alter it to present their "most powerful evidence of danger and obstruction."
They went on to say that the intention behind such an underhanded tactic was to make Diddy look even more dangerous than the unedited video portrayed.
