'Rust' Armorer Hannah Gutierrez-Reed’s Lawyer Slams Prosecutor's 'Win At All Costs' Attitude During Bid For Case Dismissal

The lawyer of former "Rust" armorer Hannah Gutierrez-Reed has filed to dismiss her case.
Earlier this year, the 27-year-old armorer was found guilty of involuntary manslaughter in connection with the death of cinematographer Halyna Hutchins. She was sentenced to 18 months behind bars.
However, on Friday, Alec Baldwin saw his involuntary manslaughter trial dismissed after the judge ruled that the prosecutors had violated the Brady rule and hid evidence that could have been favorable to Baldwin.
Armed with this new information, "Rust" armorer Hannah Gutierrez-Reed's attorney Jason Bowles is looking to get her released from prison.
'Rust' Armorer's Lawyer Wants Her Released From Prison Following Alec Baldwin's Trial
Jason Bowles, the attorney representing former "Rust" armorer Hannah Gutierrez-Reed, wants to see his client released from prison after Alec Baldwin's trial was dismissed with prejudice following the discovery of new evidence that had not been disclosed to the defense. This means that Alec Baldwin can no longer be held criminally accountable for the death of cinematographer Halyna Hutchins, although he is still facing several "Rust" civil lawsuits.
“We are going to be filing on the same basis on discovery violations which have occurred throughout her case and continue to occur,” Gutierrez-Reed’s attorney Jason Bowles told NBC News hours after Baldwin’s case was dismissed on Friday night. “Things that I learned today that happened... absolutely shocking.”
The 'Rust' Armorer's Attorney Wants Kari Morrissey Removed As Special Prosecutor
On Tuesday, Jason Bowles filed an expedited motion in New Mexico asking for her case to be dismissed or for her to receive a new trial as soon as possible. The filing cites “egregious prosecutorial misconduct” and multiple allegations of “severe and ongoing discovery violations by the state.”
“The State withheld bombshell exculpatory evidence that it had a constitutional obligation to disclose and that would have resulted in a fundamentally different trial and likely a different outcome,” Bowles alleged in court documents obtained by The Blast. “In the alternative to an outright dismissal or at least a new trial, the Court should grant Ms. Gutierrez-Reed’s already filed motion for immediate release pending appeal.”
In addition, her attorneys also demand that Kari Morrissey be removed as the case’s special prosecutor “for the misconduct that has been found, and the violations committed in Ms. Gutierrez Reed’s case.” In the documents, Bowles reveals that his defense team “has also become aware of another possible 900 or so pages of material related to state’s witnesses Bryan Carpenter and Haag” that was disclosed to Baldwin’s legal team but not disclosed to them and slammed Morrissey's "win at all costs" attitude toward the trial.
Hannah Gutierrez-Reed's Family Wants To See Her Case Dismissed
Hannah Gutierrez-Reed’s father, veteran armorer Thell Reed, 81, wants to see his daughter released from bars. He said that she was used as a “scapegoat” by prosecutors, who alleged that she had brought live ammunition onto the film set. It is still unclear where the ammo came from. During her trial, props supplier Seth Kenney insisted that he had only given Gutierrez-Reed dummy rounds.
On Friday night, Thell Reed, 81, told the Daily Mail that it was a “good” thing that the judge decided to dismiss the case against Alec Baldwin and felt that “Hannah’s case should also be dismissed” based on the misconduct of the prosecutors.
"There’s a lot of evidence that hasn’t been heard at all," he alleged. "They [the prosecution] suppressed all the important evidence and I guess [Baldwin’s] attorneys brought it out."
'Rust' Special Prosecutor Steps Down Due To Ethical Concerns
On Thursday night, Alec Baldwin’s legal team filed a motion to dismiss the trial based on the buried evidence. On Friday morning, special prosecutor Erlinda Johnson – who did not work on Hannah Gutierrez-Reed’s trial – quietly resigned in light of the new evidence. On Friday, she told Chris Cuomo on NewsNation that she had to walk away from the trial due to ethical concerns hours before Judge Mary Marlowe Sommer decided to dismiss the charges in their entirety.
"We have an obligation as prosecutors, we have an obligation not only to the people, but to the defendant and our obligation is to make sure that all the evidence is turned over," she explained. "We don't get to decide what the defense is going to be. Our job is to ensure transparency and to ensure that the defendant has everything that the prosecution has gathered. What they do with it, that's up to them.”
