Jennifer Hudson’s ex, David Otunga, is accusing the singer of saying one thing and doing another when it comes to their custody battle — and he wants her found in contempt of court.

On December 11, Otunga filed an emergency petition accusing Hudson of being in contempt of court and seeking sanctions.

Otunga claims that last month, while Hudson was having police serve him with her emergency order of protection, she also issued an exclusive statement to PEOPLE regarding their split. Her statement said her actions "are solely taken in the best interest of their son."

Otunga says this release not only damaged his reputation, but at the time it was released he was being forcibly removed from their family home in front of their son and Hudson wasn’t even home (instead she was on stage in Chicago). Otunga says Hudson’s priority on that night and thereafter was to create negative press about him and not to protect their child.

He goes on to say that Hudson and her legal team apparently thought it was more important to issue a press release than give Otunga notice about her petition before or even after it was filed.

Despite the court order stating each party is prohibited from disseminating photos or making comments about their child, Otunga claims Hudson gave an interview to an entertainment news show that showed numerous photos of their son and said his name throughout. He claims she violated the court order with the interview.

Otunga wants Hudson found in civil contempt of court and sanctioned for her actions. He is also asking that he not be held to a gag order she can’t follow.

Presently, the gag order remains in place until a hearing next month.
