Margera's wife, Nicole Boyd, filed for legal separation in March, stating his drinking problems as the primary reason. The 10-year-long marriage stopped after Boyd realized that her husband's behavior was dangerous to raising their child, Phoenix.

At the time, the model noted that it was a "hard choice" to make. However, it was necessary, as she had to "protect herself and her son." The couple experienced hurdles during their marriage, especially ones related to Margera's battles with alcohol abuse.

This warranted his admission into a correctional facility in 2018. While he has been in and out of facilities since then, Margera decided to be more serious about getting help. This followed Boyd's decision to seek full custody of their five-year-old son in 2021.

The most recent update on the estranged couple's legal battle is that Boyd currently has temporary custody of Phoenix. A court granted this request following Margera's August arrest for public intoxication. Boyd was physically present at the court during the proceeding, while Margera joined via video call.

He previously requested both physical and legal custody of Phoenix, accusing his wife of trying to keep their son away from him. However, the court ruled in favor of Boyd. The duo is expected to be back in court in a few months. However, Phoenix will remain in physical custody with Boyd while Margera gets to FaceTime him up to four times a week.
