Reese Witherspoon Is Officially Divorced From Jim Toth After Signing Agreement

Reese Witherspoon and her husband Jim Toth are officially divorced after signing a divorce agreement and filing it with the courts.
According to court documents obtained by The Blast, the “Legally Blonde” actress was the one who filed for divorce, citing “irreconcilable differences” as the reason for the split. On August 2, 2023, the two filed legal documents with the Nashville, Tennesse courts to officially complete the divorce making them legally single.
Reese Witherspoon and Jim Toth Settle Their Divorce, Pre-Nup In Place
In Davidson County, where the former couple filed for divorce, the couple is required to take a parenting course which is submitted to the court after its completion. It should be noted, a "permanent parenting plan" for their child was filed with the judge for approval. In other words, it looks like the former couple has a solid custody arrangement in place.
The couple first went public with their engagement in December 2010 and tied the knot in March 2011 on a private ranch in California. The couple also signed a pre-nup in March 2011 and both parties have agreed to it. The prenup covers "adequate and sufficient provisions" for their assets and debts. In most cases, it will divide up the property into he get his, and she gets hers.
Although the specific details of the divorce have yet to be made public, the final divorce decree has been submitted and a marital dissolution agreement has been signed by both parties. As previously stated, the two have worked out a custody plan regarding their young son. The two agreed on a divorce, signed it, and submitted it to the court, making the divorce official.
The Former Couple Maintains Committed To Co-Parenting Their Son
On March 24, 2023, the couple posted a short statement announcing their divorce to Instagram signed “Reese and Jim.” The message read, "We have some personal news to share... It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness, and mutual respect for everything we have created together."
"Our biggest priority is our son and our entire family as we navigate this next chapter," they added. "These matters are never easy and are extremely personal. We truly appreciate everyone's respect for our family's privacy at this time." The post has since been deleted.
Although fans were shocked to hear that the former couple was calling it quits only days before their 12-year anniversary, an insider told People magazine that the split was an “amicable decision” and that the two are committed to co-parenting their ten-year-old son. “They really are the best of friends and this is such an amicable decision. They are so committed to co-parenting together,” an insider shared. “They are invested in their whole family and making this as smooth as possible for everyone.”
The Exact Reason For The Couple's Split Is Unclear
Multiple outlets have been trying to uncover the specific reason why the former couple decided to go their separate ways. “There’s no big scandal or drama, just two people who essentially became co-parents and don’t really have any romantic feelings for each other anymore,” an insider told Page Six shortly after their statement was posted to Instagram.
However, The Sun reported that Toth was going through a “midlife crisis,” alleging that "This process of uncoupling really began in late 2021 when it became clear to everybody who knew both of them that they were itching for life apart from each other.”
Even though some sources said that the split was amicable, one source told PEOPLE magazine that the “Big Little Lies” actress is “obviously disappointed and upset” by the split. The insider went on to say, “She never saw herself getting another divorce," adding, "They love Tennessee and this is their focus. They will continue to co-parent amicably." The source added that "there is no drama" around their divorce.
"After she was set up with Jim, their relationship moved quickly. Reese was thrilled by his attention and excited to marry him," the insider continued. "They are two very different people though. Reese is headstrong and focused. Although very hard-working, Jim is more laidback."
The “Sweet Home Alabama” actress also shares two children with her ex-husband Ryan Phillippe: Ava, 23, and Deacon, 19. Witherspoon was married to the “Cruel Intentions” actor from 1999 to 2008.
