Russell Simmons was denied by a judge in his plea to throw out a rape lawsuit and now he has until the end of the month to respond to the allegations.
On December 5, a Los Angeles judge ordered the lawsuit accusing Simmons of rape can continue on, despite the mogul’s attempts to have the case dismissed.
The judge has ordered Simmons to answer the allegations in the complaint within 20 days.
The order notes that Simmons’ argument that his accuser did not give a specific date of the alleged incident is irrelevant since “the elements of the three claims (forcible rape, intentional infliction of emotional distress and negligent infliction of emotional distress) do not require a date of the incident.”
A hearing has been set for next month.
A rep for Simmons tells The Blast, “These allegations are made up of whole cloth. This ruling simply allows her to file her complaint. We will be filing a motion for sanctions against her and her lawyer for bringing such a frivolous suit.”
Earlier this year, Simmons was sued by a woman (who filed under the name Jane Doe) over an alleged rape in 1988.
Doe claimed the incident went down after she attended a Def Jam concert with her son.
The woman claimed in her lawsuit that Simmons approached her and invited them backstage. She claimed he then invited her to an afterparty at a hotel nearby, which she went to after dropping off her son.
Once at his hotel room, she alleged he closed the door and said, “I’m going to f*** you.” When she protested, she claims he told her, “I am going to f*** you or I’m going to f*** your son. You decide.”
She claims he then threw her on the bed and raped her. The lawsuit is seeking $10 million in damages.
Russell Simmons has denied the woman’s story and argued the statute of limitations had already passed and demanded the case be thrown out.
Simmons accused the woman of filing her complaint only for “purposes of publicity, which this case has garnered.”
The lawsuit, he claims, “is nothing more than an attempt by Jane Doe to extort large sums of money from Mr. Simmons and for her lawyer to try to make a name for himself.”
The case is ongoing.
