'RHOBH' Star Erika Jayne's Husband Thomas Girardi's Family Files For A Conservatorship

'RHOBH' Star Erika Jayne's estranged husband Thomas Girardi's family has filed for a conservatorship after claiming the famous trial lawyer's condition has sadly deteriorated, and he is unable to care for himself.
The 'Real Housewives of Beverly Hills' star is not the person who petitioned the court for control of her husband's estate -- instead, his brother Robert Girardi is asking a court to hand over control to his family to take care of the 81-year-old.
According to legal documents, obtained by The Blast, Girardi's family claims the situation is so bad, he is now having trouble with times, dates, or even places.

In the legal documents, Robert Girardi filed a declaration spelling out the sad details including major issues with Tom's day-to-day activities.
"Thomas V. Girardi ("Tom") is a renowned trial lawyer, responsible for some of the most notable mass tort verdicts in California. However, at age 81, Tom's current condition has sadly deteriorated to the point where he cannot care for himself without assistance. His short-term memory is severely compromised and, on information and belief, he is often not oriented as to date, time or place," he wrote.
Adding, He "has first-hand knowledge that Tom lives alone and can not care for himself."

Interestingly, Tom's brother claims the famous and wealthy attorney could lose many of his employees due to his current financial situation -- which includes his housekeeper -- who has handled his groceries for over 25 years.
"For at least 25 years, Tom has employed help to assist him with day-to-day functions," Robert wrote.
He continued, "For instance, (Robert) believes he has not purchased his own groceries in years. However, Tom's longtime housekeeper of 25 years is set to quit due to Tom's financial situation: he cannot pay them any longer."
At this point, Tom's family says he has "certain friends looking out for him to make sure he has sufficient food and that he makes it to a given appointment on time." But, If he is "left to his own devices" It is highly doubtful that he could manage most of the activities of daily living "for any significant period of time without assistance."

As we reported, Tom Girardi is currently in Bankruptcy and has been sued multiple times for issues pertaining to his handling of finances within his law firm.
Tom's family believes he is no longer in a position to manage his own finances and to 'resist fraud or undue influence.' According to the documents, Girardi doesn't understand "the dire situation" he is in financially, and claims "his money situation will clear up next week."
Bottom line, Tom's brother claims it is obvious to him "and anyone else who knows him" that Tom cannot "make the decisions needed to handle the important issues."
Although Erika Jayne is listed as Tom's spouse in the documents, the couple is currently in the middle of a divorce. It's unclear if the reality star will sign off on the conservatorship.
At this point, it is in the hands of a L.A County judge.
