Reality star Khloé Kardashian's company Good American is being sued by a model to the tune of $100,000.
According to court documents obtained by The Blast, one model who did work for the company in November 2021 claims she wasn't paid on time. Now, instead of $3,500 for a day's worth of work, she wants to be paid over $100,000.
Khloé Kardashian's Company Good American Sued By Model For $100K
According to court documents obtained by The Blast, model Jourdan Whitehead is suing Good American for a penalty late fee after not paying her on time for services performed over the course of one day. The documents, which were filed in Los Angeles county on Wednesday, February 15, state that Whitehead is a “professional actor who earns a living by working as an actor in the production or broadcasting of motion pictures.”
According to the California Labor Code, the “production or broadcasting of motion pictures” means “the development, creation, presentation, or broadcasting of theatrical or televised motion pictures, televised programs, commercial advertisements, music videos, or any other moving images, including, but not limited to, productions made for entertainment, commercial, religious, or educational purses, whether these productions are presented by means of film, tape, live broadcast, cable, satellite transmission, Webcast, or any other technology that is now in use or may be adopted in the future.”
In November 2021, Whitehead claims that she did work for Good American on November 17, 2021, in the city of Calabasas, California. Whitehead says that she “performed modeling services pursuant to and under the direction and complete control” of the company, along with its personnel and agents.
The only time that Whitehead did work for the company was during that one day. She claims that, according to the initial document, she was supposed to be paid at a rate of $3,500.00 per day. In other words, since she only worked that one day, she was only supposed to be paid for one day of work.
Good American Model Wants Over $100K After Not Being Paid On Time
Given the Good American pay cycle, Whitehead claims that she was “entitled” to be paid by December 10, 2021, according to the court documents. However, Whitehead claims that she did not receive the payment until March 11, 2022, which is months after she was supposed to get paid.
Whitehead is now claiming that their “failure to timely pay [her] her wages was willful in that [Good American] was required to make timely payment, were able to do so, but chose not to do so,” thus entitling her to receive a late payment penalty under California Labor Code 203.
According to legal documents, “Labor Code section 203 provides that upon an employer’s failure to make timely payment of wages, the employee’s wages shall continue as a penalty until paid or for a period of up to 30 days from the time the wages came due, whichever period is due.”
Since the payment was over thirty days later, Whitehead claims she is “entitled to an award of penalties in the amount of $105,000.00, which is [her] daily rate multiplied by 30 days.” She also wants the company to cover her attorney’s fees and additional legal costs.
