'RHOBH' star, Erika Jayne, has no intention of divorcing her estranged husband, Tom Girardi, at least not anytime soon. The reality tv star previously filed for divorce from her husband of 21 years in 2020; however, things were halted due to a court case.

The former couple was sued for allegedly embezzling $2 million from the sum entrusted to the former attorney for the Lion Air Flight 610 family victims. The reality tv star denied any knowledge of the matter and was dismissed from the case shortly after.

In a recent "Real Housewives of Beverly Hills," the 50-year-old got candid about the current state of her marriage and her reason for not continuing her divorce filing. According to Jayne, she would have to relinquish alimony to Girardi if they were legally separated.

Jayne revealed why she was content staying separated from her husband, Girardi. In a Wednesday night "Real Housewives of Beverly Hills" episode, the 50-year-old said that her main reason for staying separated was to avoid paying him alimony post-divorce.

During the confessional, she said, "It's ironic, but if I was divorced from Tom, I'd have to pay him alimony." "I'll stay married, thanks," Jayne added with a laugh. She also talked about the legal and financial troubles the couple was facing at the moment as another reason for avoiding the divorce.

In a FaceTime call with Lisa Rinna, the tv personality explained, "I can't get a divorce right now. Like, I'm legally separated, so my life has moved on, and everything is separate. But I can't get a divorce right now. There's so much legal s—t going on." Jayne then described the entire situation as "weird" and that she wanted it to be over.

Jayne Is 'Mourning' Her Marriage

While on-screen, Jayne revealed that she still mourned her marriage with Girardi and shed light on her more treasured moments. The 50-year-old said, "I think that gets lost in the sensationalized version of it all. This was someone I was married to for over 20 years and was with, like, 23 [years]. It's difficult."

The "Pretty Mess" author continued, "There are real moments of sadness, real moments of — like when the holidays came around, you know, for Christmas, I would just remember how much fun we would have. … But what are you going to do with that? These things happen in life. They happen to everyone; everyone's mourning something."

Jayne also talked about how much strain she was put through due to parts of her private life being televised. The 50-year-old described the season as a "real fallout" and that she constantly tried to pull herself together by mixing alcohol and antidepressants on occasion while on set. "I wanted to have some fun, and I wanted to not feel so heavy. So that's what I did," she said.

She Filed For Divorce In 2020

Jayne initially filed for divorce from the 83-year-old in November 2020. The duo was married for 21 years before the decision to part ways. A month after the divorce filing, Jayne and Girardi were accused and sued by Edelson PC for allegedly embezzling $2 million out of the funds put aside to settle the families of the victims of the Lion Air Flight 610.

Jayne denied the charges leveled against her, and earlier this year, she was dismissed from the fraud lawsuit. Besides that, she got slammed with a $50 million lawsuit for racketeering and a $2.1 million lawsuit for aiding and abetting.

Girardi, on the other hand, was placed on a conservatorship supervised by his brother after being diagnosed with Alzheimer's. Effective July 2021, Robert Girardi will reportedly be in charge of the former attorney's health and estate.

Erika Jayne Was Made To Turn Over $750,000 Earrings

As reported by The Blast, the TV personality was ordered by a judge to turn over a pair of diamond earrings worth $750,000. The jewels were gifted to her by her husband in 2007 and were reportedly "stolen property" because they were purchased using the embezzled funds.

According to a source close to Jayne, she relinquished ownership over the earrings months before the court's decision. Now the 50-year-old only wanted the entire issue to come to a close and the chance to move forward with her life.

The source said, "She honestly just wants all of this behind her and will do whatever is necessary to do so. She is doing the best she can to move forward with her life."
