According to the filing, Burns claims he expressed to Dante he did not want to fight him, considering his age and the fact that he was suffering from heart disease. But, he says Dante started attempting to incite a physical altercation by referring to his "Jew nose" and commenting that he was wearing slippers and was an "old Jew."
At this point, the lawsuit states Dante approached the person's table and appeared to be preparing to physically "attack him." Burns says he informed a waitress he was leaving, and Dante yelled, "See sissy running away!" Plus, he says Peter "began chasing him around a large rectangular table in the center of the small intimate section of the restaurant."
The police were called to the scene, and Burns says he told officers he "felt trapped in a very small space being chased by [Dante]" and "requested the operator stay on the phone with him as he waited because he feared for his safety."
