Alec Baldwin is being sued for the deadly shooting on the set of 'Rust,' claiming the actor should have "double-checked" the gun before handling it.
According to multiple reports, key gaffer Serge Svetnoy just filed a lawsuit against Baldwin, the armorer Hannah Gutierrez-Reed, and Dave Halls, over the death of Halyna Hutchins. The lawsuit alleges negligence on the part of all the defendants, which has caused him severe emotional distress.
In the lawsuit, Svetnoy claims Alec Baldwin "owed a duty to (him) and other crew members and actors on the 'Rust' set to handle the Colt Revolver provided to him by defendant Halls with reasonable care and diligence for the safety of the 'Rust' cast and crew." It continues, "This duty called for Defendant Baldwin to double-check the Colt Revolver with Halls upon being handled to ensure that it did not contain live ammunition."
Alec Baldwin Accused Of Not Handling The Firearm With Care
Interestingly, the lawsuit also points out that Baldwin should have handled the weapon with more care, saying, "This duty further called for him (Alec) to handle the Colt Revolver as if it was loaded and to refrain from pointing it at anyone."
Shockingly, the legal documents claim that the scene Alec Baldwin was rehearsing DID NOT call for him to pull the trigger. Specifically, it says it called for him to draw the gun and point it in the "general direction" of the camera, but, "the scene did not call for Baldwin to shoot the Colt Revolver.
It should be noted, Svetnoy claims the bullet that killed Hutchins and injured Joel Souza, actually zoomed right by him and almost struck him too. As we reported, Serge says he was one of the first people to attend to Halyna after she was shot, and continued to bleed profusely. At the time, he was trying to comfort her and keep her conscious.
Alec Baldwin Accused Of Negligence As A Producer Of 'Rust'
According to the new lawsuit, Svetnoy also points the finger at Baldwin as a producer of the movie, saying "they attempted to save money by hiring an insufficient number of crew members to safely handle the props and firearms." To prove the point, the legal documents attempt to point out lapses on the set of 'Rust,' saying they violated industry norms, "declining requests for weapons training days, failing to allow proper time to allow for gunfire, failing to send out safety bulletins and spreading the staff too thin."
In the days following the deadly shooting, a report suggested that crew members were shooting 'target practice' in the hour before the tragedy, something Svetnoy calls "outrageous."
Deadly 'Rust' Shooting Is Still Under Investigation
In the end, Serge points out he has been friends with Hutchins for over 5 years and considered her a good friend. Plus, the entire ordeal was so traumatic, he believes he will never get over it.
As we reported, the shooting is still under investigation by authorities in New Mexico. At this point, there is nothing to indicate Alec Baldwin did anything wrong except fire the fateful shot, after being handed the weapon. Obviously, Baldwin himself had nothing to do with actually loading the gun.
The case is ongoing.
