Tori Spelling better not count how many orders of Rocky's Choice she can afford with her settlement money from Benihana, because the state of California claims they get first dibs to pay off her outstanding tax debt.

The Franchise Tax Board in California just filed documents explaining Spelling still owes them $338,595.78 in unpaid taxes from 2014-2015.

They want to make sure any money the actress receives in the settlement from her lawsuit against Benihana be turned over immediately to satisfy the tax debt.

Back in 2015, Spelling sued Benihana after she slipped and fell into one of the hibachi grills while at the Encino, CA location. She suffered deep second and third degree burn injuries in the accident.

Benihana claimed Spelling's injury was due to her failure to "conduct herself as a reasonable guest," but the two parties reached a confidential settlement in September.

It's unclear if Benihana will flip the cash into a chef's hat before turning it over to the tax board.
