‘RHOC’ Star Josh Waring Demands Attempted Murder Case Be Thrown Out

The son of “Real Housewives of Orange County” star Lauri Peterson is attempting to get a judge to drop the attempted murder case against him just weeks before the reality star’s trial is set to start.

Josh Waring is currently locked up after being accused of attempting to kill a man named Daniel Lopez, who was shot outside a sober living home in 2016. Waring pleaded not guilty.

Waring has been behind bars for over two years awaiting trial on the attempted murder charges, which, if convicted, could have him locked up in prison for life. Waring and the Orange County Sheriff’s Department will square off in court next week ahead of the trial, which is scheduled to begin on November 26.

Josh Waring is attempting to subpoena nine officers at the Orange County Sheriff’s Department. Included in the list of officers are the individuals involved in the ongoing controversy over some of Waring’s jail phone calls being recorded and allegedly listened to by law enforcement.

Waring previously filed a $1.4 million claim against the County of Orange over his allegation they unlawfully recorded his calls in jail in violation of his attorney-client privilege. Waring claims “at least 1,4000 calls were intercepted, recorded and turned over to the investigating prosecution team, violating a court order.”

The Orange County Sheriff’s Department claimed the recordings were made in error by a third-party company and says the calls were not illegally listened into by law enforcement.

The Orange County Sheriff’s Department wants the court to quash the subpoenas, arguing the testimony from the officers was irrelevant to Waring’s motion to dismiss. The OCSD also takes issue with having nine officers deal with this hearing would be a significant burden on the department.

Josh Waring believes the testimony will help his defense and possibly get him out of jail.
