Museum of Ice Cream Sues Rival Ice Cream Pop-up Shop for Stealing Their Flavor

The super popular and ultra-trendy Museum of Ice Cream claims they have the market cornered on interactive ice cream experiences and they’re suing someone for trying to steal their banana split thunder.

The Museum of Ice Cream has opened locations in New York, Los Angeles, San Francisco, and will open a Miami location in the near future. The MOIC features such exhibits as the “sprinkle pool,” the “popsicle room,” the “banana split” room, the “gummy garden” room, the “cherry on top” room, the “ever-growing sundae” room, and the “ice cream tasting” room.

According to court documents obtained by The Blast, the company behind the Museum of Ice Cream, 1AND8 Inc., claims they became aware in August of plans to open an Art of Ice Cream Museum in Scottsdale, Arizona … only it wasn’t theirs.

1AND8 fired off a cease and desist letter to the Art of Ice Cream Museum, saying the planned “museum” violated their trademark. They claim the Art of Ice Cream Museum changed their name to the Art of Ice Cream Experience, but still planned for a November 22, 2017 opening.

The Art of Ice Cream Experience, according to its website, bills itself as “an instagrammable, experience celebrating Americas [sic] love of Ice Cream. You will find hidden delights in each individually themed exhibit room, each paying tribute to a favorite Ice Cream flavor or frozen treat.”

They also say, “In each room you will have an opportunity to engage with the exhibit, enjoy ice cream samples and above all indulge your selfie expression through colorful and interactive art.”

1AND8 claims that since they sent the cease and letter to the Art of Ice Cream Experience, they have added a disclaimer to the bottom of their website that reads, “NOT AFFILIATED WITH MUSEUM OF ICE CREAM.”

They are seeking an injunction to stop the opening, they want all promotional material destroyed, and are seeking damages.
