Devo Cracks the Whip on Unauthorized Merchandise in New Lawsuit

A problem has come along and Devo has dispatched their lawyers to whip it.

According to court documents obtained by The Blast, the popular 1970s band has filed a lawsuit against a company named Wildcat Retro Brands.

Devo claims they used a company called Atom Age to handle all the deals using their name and likeness. They claim Atom Age entered into a deal with Wildcat in 2016 for the manufacturing, marketing, and sale of apparel and related accessories.

But Devo claims the deal obligated Wildcat to obtain written approval of any item they developed before it went on sale.

Lo and behold, in August 2018, Devo claims they discovered Wildcat was selling items that were never approved. They claim they told Wildcat to cease and desist selling the items but they did not oblige.

They are suing for trademark infringement and breach of contract and they are seeking in excess of $300,000 in damages.
