The ex-wife of “Empire” star Terrence Howard has had enough of his attempts to delay her case against him and wants the court to move forward so she can collect on the money she is owed.
Michelle Howard — who was Terrence’s second wife from 2010-2013 — is trying to collect on a settlement the two sides agreed to back in 2013.
According to court documents obtained by The Blast, Michelle wants the court to put an end Terrence’s efforts to delay her case.
She argues that “there should be no further delay to accommodate” his and his wife Mira’s “purported Fifth Amendment concerns.”
Michelle goes on to say that there is no legitimate reason for Terrence “to receive a stay or continuance from the Court due to an ongoing criminal investigation.”
Michelle’s lawyers argue, “Matters legitimately subject to Terrence’s privilege against seIf-incrimination — if any such matters exist — have little relevance to the matters before this Court in connection with the pending RFO and, to date, Terrence has refused to explain the purported nexus between the matters at issue in the RFO, and matters that could be legitimately self-incriminatory.”
They also claim that “Terrence is not free to even invoke the privilege against self-incrimination before the family law court without demonstrating a clear nexus between the subject matter of the testimony sought from him, on the one hand, and a real possibility of self-incrimination‚ on the other hand, let alone weaponize the privilege to shut down Michelle‘s long-delayed right to the Judgment rendered oven six years and three months ago.”
Terrence and Michelle have been battling over the million dollars she has been trying to collect from him from a judgment she won in 2013.
Terrence filed documents in the case in June trying to get an upcoming hearing taken off the calendar because Howard is being investigated for tax evasion. He does not want to turn over documents or give any testimony about his finances because it might affect his criminal case.
Michelle Howard said she believes Terrence is trying to use the investigation “as both a sword and a shield” in his effort to indefinitely continue their legal battle.
Terrence has argued that Michell’s allegations are “directly correlated to the criminal investigation.”
The two sides are due in court again later this month.
