“Real Housewives of Atlanta” star Eva Marcille scored a huge victory against her ex Kevin McCall in court.

According to The Jasmine Brand, a Fulton County Court judge dismissed McCall’s case seeking custody and child support for his daughter Marley Rae.

The case was dismissed because McCall blew off his own lawsuit. He failed to respond to Marcille’s motion to dismiss. The judge found the custody battle should be heard in California, not Georgia. McCall was recently dropped by his lawyer in the case.

Back in September, McCall sued Marcille seeking time with his daughter. Marcille moved to dismiss the case saying McCall was dangerous. She also argued he never paid a dime in child support.

At a recent custody hearing, McCall was arrested after getting into a fight with police officers. Marcille and McCall have not been together for several years. She has accused him of domestic violence while they were together. After the incident he charged with a felony and is facing five years behind bars.

McCall was also charged in a separate case for alleged domestic violence. The case is still pending in Los Angeles.

In the weeks after his recent arrest, McCall has acted extremely erratic on social media. He has threatened his former friend Chris Brown multiple times. He has posted several times throwback photos of Marcille.

Marcille spoke about the alleged abuse, “Domestic violence is very, very real. I went through domestic violence. I finally found the courage to come up and talk about it about a couple years ago about what I went through with Kevin. I feel bad for women that have to deal with it. And it's actually not a laughable matter; it's something that actually makes you feel so little so you don't want to talk about it, but it really sucks."
