Amber Heard has been granted access to Johnny Depp's 'mental health' records after claiming the actors drug and alcohol abuse, along with medications to treat it, contributed to his alleged violent behavior.

According to legal documents, obtained by The Blast, Amber filed an emergency motion to force Depp to turn over all medical records including any treatment for mental health.

Earlier in the month, the Virginia court ordered Amber Heard access to Depp's medical records associated with the case.

But, she claimed Depp's attorney's did not authorize the release of his 'mental health records' at first, stating the (Johnny's) mental condition was not the subject of the order.

Heard's lawyers say they subpoenaed third party medical providers for records to help "demonstrate the link between (Depp's) drug and alcohol abuse, mental health (including prescription drugs given to treat mental health issues), and his abuse of (Amber) or other romantic partners."

In the filing, Amber says Johnny's "mental conditions in combination with his rampant use of alcohol and drugs were inextricably intertwined with the abuse she suffered at his hands"

She continued, "Johnny's relationship with reality oscillates, depending upon his interaction with alcohol and drugs. As Johnny's paranoia, delusions and aggression increased throughout our relationship so has my awareness of his continued substance abuse."

Johnny has denied abusing Amber and says it never happened. Amber says it may be due in part to his being intoxicated or as a result of his mental condition.

"And, of course, (Johnny's) mental condition also bears on his ability to recall the events he has put at issue," Heard says.

“The abuse that Mr. Depp has put at issue by filing this case is inextricably linked with his mental condition and substance abuse,” said Roberta Kaplan, Founding Partner, Kaplan Hecker & Fink LLP, and counsel for Amber Heard.

She continued, “Mr. Depp’s well-documented history of drug and alcohol abuse, as well as his serious issues with anger and violence, raise legitimate questions about his mental state during the course of his relationship with our client, not to mention his ability to remember and truthfully recount what happened. We hope that Mr. Depp will agree to be examined so that we can get to the truth and our client can put the abuse she experienced and continues to experience as a result of this lawsuit to an end.”

Johnny's lawyers agreed to provide a HIPAA waiver allowing for access to all the information Amber is seeking.

Depp's attorney Adam Waldman said in a statement, “It’s unsurprising that Amber Heard’s smear the victim tactics - seek mental health records! - mirrors Harvey Weinstein’s. It is for moments such as this that Ms. Heard hired her trio of firms - the #TimesUp lawyers who represented Harvey Weinstein.

"Mr Depp has granted a HIPAA waiver and has no fear of their attempted smears," he concluded.
