The news about Simon Cowell's smoking habit has been circulating in the headlines lately, amid Gabrielle Union's complaints that he would smoke on the set of "America's Got Talent," even though Union was allergic to cigarette smoke.

But this isn't the first time that Cowell's smoking has put him in hot water -- he also apparently smoked often enough on "X Factor" that a source says that they imposed fines on him.

In 2015, the "Daily Mirror" ran a story saying Cowell would have to pay 100 British pounds for every time he smoked at Fountain Studios in Wembley, North West London, where "X Factor" was being filmed.

An unidentified source said that being a showrunner for "X Factor" was a stressful job for Cowell, but that he would flout the rules and smoke inside, unlike others on the set.

“Simon makes no secret of the fact that he enjoys a cigarette to help him relax and obviously being on the judging panel while also running the show is very stressful."

Union says she's allergic to cigarette smoke.

The source continued:

"Rather than wait until after the show and go outside like everybody else, Simon uses the advert breaks – but because they’re so short he never quite makes it outside.”

Cowell's smoke fines on "X Factor" began to pile up, according to the source.

“People say smoking is a very expensive habit – but Simon has taken that to new heights. Over the course of a series we’re talking about literally hundreds of pounds.”

In a story May 27 on Variety, Union spoke out about her time on "America's Got Talent," saying that on the first day on the set, she saw Cowell smoking.

She said since Cowell was basically in charge, and she was new, there really wasn't any way she could say something.

“Coming onto a set and you are literally met with the very definition of a toxic work environment, and it’s being carried out by the most powerful person on the production," she says.

NBC's investigation into Gabrielle Union's firing from AGT have ended.

Union said that her health was being affected by Cowell's cigarette smoking -- never mind the fact that she was eventually fired from the show.

“I couldn’t escape. I ended up staying sick for two months straight. It was a cold that lingered, and turned into bronchitis, because I couldn’t shake it. It impacted my voice, which affects my ability to do my job.”

Cheatsheet says that NBC has concluded its investigation into Union's complaints about the show and her exit from "America's Got Talent," though SAG-AFTRA's investigation is ongoing.
