According to court documents obtained by The Blast, Heatherton’s ex-business partner, Clare Bryne, is accusing the model of refusing to turn over key documents in the lawsuit, despite being served back in June.
Bryne says Heatherton has been posting on Instagram various photos of her on a safari with her boyfriend, instead of dealing with legal issues. Heatherton’s ex-partner filed a motion to compel, demanding the judge order Heatherton to turn over the information and documents.
Back in July, Heatherton’s lawyer filed docs claiming the model had blown off paying her legal bills. She claimed her client told her she planned on filing for bankruptcy and stopped answering phone calls or letters.
Byrne says since then, the model has not filed for bankruptcy despite her statements.
Last year, Erin Heatherton was sued for $10 million by her former business partner Clare Bryne.
Bryne claimed she was working on a sportswear line with Heatherton named RetroActive. She accused the model of wearing the line to several public events but months later, Heatherton abandoned the project without explanation. Bryne claimed she was promised 40% of the company and sued for $10 million she believed she would have made.
Heatherton counter-sued the woman, accusing her of ruining the planned sportswear line. She claimed she paid the stylist $25k to work on the line with her but she turned in “inadequate” samples and caused the line to be delayed.
Heatherton sued demanding the $25k she paid Bryne to develop the line.
The case is ongoing.
