Rapper DaBaby has reached a settlement with the music video vixen he sued over an alleged extortion attempt.
According to court documents obtained by The Blast, DaBaby (real name: Jonathan Kirk) has hashed out a deal with model Marjorie Guaracho which will bring an end to his lawsuit against her.
DaBaby sued Guaracho over her threatening to sue him after appearing in his music video. He said she had lawyers fire off a legal letter to his record label, which caused other problems. His lawsuit demanded Guaracho pay damages for allegedly trying to shake him down for money.
The documents state, “The essence of the settlement is that the Plaintiffs have full and complete rights with respect to Plaintiff’s image and likeness in connection with the video entitled “Vibez”. One of the conditions to the settlement is the enyry of an order confirming the settlement, acknowledging the Plaintiffs possess all of the Defendant’s rights with respect to the Video.”
The judge has yet to sign off on the settlement.
Earlier this year, DaBaby and South Coast Music Group filed a lawsuit against Marjorie Guaracho.
Back in September 2019, DaBaby hired a production company to produce a music video for “Vibez”. The video was filmed on September 27, 2019 in Miami, Florida.
The production company hired a casting company to find background performers to appear in the video. The defendant, Marjorie Guaracho, was one of the women hired to perform in the background. DaBaby said Guaracho was informed of the video concept, signed a release and was paid $100.
DaBaby said the video featured more than 40 girls and Guaracho appeared for less than 2 seconds. After the release, Guaracho fired off a cease and desist letter to DaBaby’s label Interscope accusing them of stealing her performance and demanding punitive damages and attorney fees.
The model accused DaBaby using footage of her to make it appear she “endorses pornography.” She said she was “shocked” after seeing the final music video. She estimated her damages to be in excess of $75,000.
He sued demanding the court order the model signed away her rights and for unspecified damages against Guaracho.
