After the brief appearance, the groping trial was postponed until October 10.

Prosecutors said Tuesday they are still waiting on some evidence in the case against the actor. Jury selection was set to start this week.

Cuba was accused of groping a woman's breast and squeezing it without consent. The allegation took place at the Rooftop Bar & Lounge in Times Square on June 9.

His attorney's spoke outside the courthouse immediately following the hearing.

“We believe the only reason he was arrested and prosecuted was because of his celebrity status,” his attorney said.

Leading up to the hearing, Cuba's lawyer claimed he believed the victim may not be cooperating with police for their case.

"The court ordered trial to commence Tuesday, September 3, 2019, although there is speculation of the Accuser's lack of cooperation with the District Attorney's office. The defense and Cuba Gooding Jr. will appear in court and press to start the trial as directed by the court...considering that 77 days have elapsed since Cuba Gooding, Jr. was arrested." Heller said in a statement.
