Gooding Expected In Court Tuesday

Actor Cuba Gooding Jr. is expected to be arraigned on Tuesday in Manhattan Supreme Court on an additional charge in his ongoing groping case.

Court Was Delayed For New Allegations

Gooding, 51, was in Manhattan Criminal Court on Thursday for a trial on the initial charges when Judge Marisol Martinez Alonso delayed jury selection in the groping case for the new, as-yet-unnamed charges.

Gooding Could Face a Year In Prison

In the previous charge stemming from a June 9 incident, an accuser says Gooding squeezed her breast.

That charge could mean a year in prison for Gooding.

The alleged incident took place at Magic Hour Rooftop Bar at the Moxy NYC Times Square Hotel. Gooding surrendered in June and was charged with third-degree misdemeanor sexual abuse and forcible touching.

He pleaded not guilty to that charge.

What Is This New Charge?

This newer charge may be more serious, as it's forced the case to move up a level, from criminal court to State Supreme Court. But Gooding's lawyer, Mark J. Heller, says it could be a delay tactic.

Gooding's Lawyer Says It's All a Delay Tactic

According to Heller, prosecutors have already conducted interviews, seen video and gathered DNA evidence on the initial charge, so there's no reason to delay court proceedings.

"All of this to support a three-second video that did not reveal Cuba committing any crime.

"Rather than be embarrassed and answer that they were not ready today, they simply used the technique of moving this through an indictment in the Supreme Court."
