Britney Spears' Father Claims She Has NEVER Asked To Be Let Out Of Conservatorship

Britney Spears' father is arguing that details of the pop star's conservatorship should continue to be kept private because it contains highly confidential medical information and sensitive details about her and the children. Plus, he claims she has never legally asked to be let out of the 'voluntary' case anyways.

According to new legal documents, obtained by The Blast, Jamie Spears claims Britney's lawyer is 'grandstanding' by trying to unseal parts of her conservatorship case, and is questioning her "capacity" to make such a monumental decision.

Britney's father is arguing to keep her medical records sealed and says it's released could have major detrimental effects on Britney and her kids.

Britney Spears Father Admits Conservatorship Is 'Voluntary'


In a shocking admission, Jaime Spears confirms Britney's conservatorship is 'voluntary' but claims she has never asked to be let out of the case, so why would the court change anything that is currently in place.

" This is a voluntary conservatorship, and Ms. Spears can apply to the Court at any time she wishes to terminate the conservatorship of either the person or the estate, or both. To date, she has not done so," Jaime's filing states.

As we reported, Britney has filed documents saying she appreciates her fans be so involved in her life, and believes parts of the case should be open to the public and not hiding "in the closet" like her father wants at this time.

Jaime Spears Questioning Britney's 'Sufficient Capacity' To Make The Decison


According to the filing, Jamie Spears is questioning Britney's mental capacity and ability to make such a massive decision.

"In fact, one of the issues, in this case, is going to be whether Ms. Spears has the sufficient capacity to form an intelligent preference in order to make an effective nomination of a conservator," it reads.

As you know, Britney has filed documents asking the court to make an investment bank the conservator of her estate and asking her dad no longer be allowed to be the sole conservator.

"The conservatorship of the person and the estate are inextricably entwined as they are both conducted in the best interests of the conservatee, and involve issues that necessarily pertain to the conservatee’s medical condition, her competence to manage her personal financial affairs, and her susceptibility to undue influence," Jamie's filing states.

In other words, this issue over who will manage Britney's finances is so connected to her personal conservatorship, all of it should be protected from the public so that sensitive information (like medical records) will remain sealed.

Britney's Dad Claims Releasing Her Medical Records With Have 'Detrimental' Effects


As we reported, Jamie is asking the court to re-appoint Andrew Wallet to the case...a lawyer who was involved in the case for many years before retiring.

According to the filing, Jamie believes the move will be helpful to Britney's life and "business relationships" in the future.

"Undoubtedly, however, resolution of the Petition and the re-appointment of Mr. Wallet as Co-Conservator of the Estate, will inevitably lead to issues being raised that relate to Ms. Spears’ health, her capacity to make informed decisions, and her relationships (including business relationships), as well as the impact of the upcoming changes to the Conservatorship on Ms. Spears and her children," it reads.

At this point, the judge in Britney's conservatorship will make the decision to make it public, and who will be placed as the conservator of her estate.
