2 Chainz is denying he instructed his bodyguard to assault a photographer inside 30 Rockefeller Center and is demanding the battery lawsuit against him be dismissed completely.
As The Blast first reported, photographer Richard Capak sued 2 Chainz and his bodyguard, Rory Smith, accusing the rapper of authorizing the actions of his guard that ended with the guy landing in the hospital with a laceration to his head.
The alleged incident went down in October as 2 Chainz was walking into 30 Rock to perform on “The Tonight Show with Jimmy Fallon.” When police arrived at the scene, they found the 64-year-old photographer Capak bleeding from his head. He was later transported to the hospital.
2 Chainz's bodyguard was arrested and charged with assault. He denies all allegations of wrongdoing.
On May 18, 2 Chainz filed docs in the case denying he did anything wrong on the day in question. He claims any injuries the photographer sustained were caused by third parties he had no control over, and he cannot be held liable for the actions of others.
Furthermore, he says Capak assumed the risks and dangers when he failed to exercise due care on his own behalf.
2 Chainz is demanding the suit be dismissed completely.
A judge has yet to rule.
