Britney Spears’ mom, Lynne Spears, and her temporary conservator, Jodi Montgomery, support the pop star in her battle to remove Britney’s father, Jamie Spears, as conservator of the estate.
In new court documents obtained by The Blast, Britney’s new attorney, Mathew Rosengart, refers to Britney Spears’ conservatorship as “increasingly toxic and is simply no longer tenable” when it comes to Jamie Spears’ involvement. Britney’s new team of attorneys is asking the court to consider whether the conservatorship “should be terminated in its entirety and whether—in addition to stripping his daughter of her dignity, autonomy, and certain fundamental liberties—Mr. Spears is also guilty of misfeasance or malfeasance warranting the imposition of surcharges, damages, or other legal action against him”.
Both Jodie Montgomery and Lynne Spears submitted declarations in support of Britney’s request to suspend and remove Jamie Spears as conservator. Jodi says “I have had numerous, ongoing
conversations with the medical team and we all agree that it would be best for Ms. Spears’ well being and mental health that her father stop acting as her Conservator” and “in my opinion, Mr. Spears’ removal as
Conservator is critical to [Britney Spears’s] emotional health and well-being and in the best interests of the conservatee.” Lynne Spears says “the relationship between the conservatee and Mr. Spears has dwindled to nothing but fear and hatred of Mr. Spears by the conservatee due to Mr. Spears’ behavior, including his complete control over her, his mistrust of her, his coercion of her, his ‘bartering’ with her over what she can and cannot do for whatever reward or punishment he is willing to mete out his constant threats, and his decision-making overall aspects of her life.”
There is currently an investigation into the alleged issues with Britney’s conservatorship, and Britney has made it clear she wants to have her dad suspended as sole conservator of the estate, and nominate a new conservator, Jason Rubin, is his place. The #FreeBritney community gets a shout-out in the recent conservatorship filing, and that Britney’s attorney agrees that “the purpose of the conservatorship is to fight to protect the conservatee’s interests rather than gain control over the conservatee”. In other words, the need to consider and respect Britney’s own wishes when determining actions in her best interests is what court investigators use to assess a conservatee’s wishes and determine if the conservator is acting in the best interest of the conservatee (Britney).
Britney Spears has been vocal in her conservatorship proceedings, and the judge overseeing Britney’s case has also shown support for the pop star. The judge said, “Everybody should be working collaboratively to help Ms. Spears get to the point where she’s trying to get to, that she’s articulated in the last couple of hearings. So it’s not about anybody else, it’s about her.” Britney’s attorney states in the petition for suspension, “Mr. Spears’s service as conservator has become and now is extremely detrimental to the central issue: the well-being and best interests of Britney Spears” and “any father who genuinely loves his daughter and has her best interests at heart should willingly step aside in favor of the highly-respected professional fiduciary nominated here”.
Interestingly, Britney’s attorney claims Jamie Spears has been paying himself $2000 more than he has allotted to Britney, and it’s her money! Plus, Britney’s attorneys claim Jamie Spears’ cut from Britney’s Vegas residency is estimated to be at least $1.2 million.
