The Broadway production, based on an original story by J.K. Rowling, Jack Thorne, and John Tiffany, takes place 19 years after the events of the books and films, following the next generation of Hogwarts students. Lively’s attorneys strongly dispute that characterization, and they’re fighting to ensure the case reaches a jury. In their latest filing, also obtained by the outlet, her team insists that “the record evidence is clear: Lively’s claims survive summary judgment and must be sent to a jury.”

They argue the actress’s experience on the "It Ends With Us" set was far more serious than Baldoni’s camp is willing to admit. “This is not, as Defendants claim, a story of minor annoyances fueled by creative differences, but instead one of a toxic work environment,” her lawyers wrote, accusing Baldoni and the Wayfarer parties of “peddling their victimization narrative” while attempting to paint Lively as the aggressor to “avoid accountability for the hostile environment they created.”

The filing goes even further, stating that Baldoni and the co-defendants are trying to “shield themselves from trial, and deny Blake Lively her day in court, by throwing the kitchen sink at Lively’s sexual harassment and retaliation claims.”

“But Defendants’ scattershot theories collapse under the weight of the overwhelming evidence,” her legal team concluded.

With a trial currently scheduled for March of next year, the confrontation between the former co-stars appears poised to escalate even further.
