Todd Tucker, the soon-to-be ex-husband of "Real Housewives of Atlanta" star Kandi Burruss, has made a shocking request in court documents filed shortly after Burruss announced their plan to divorce. The couple wed in 2014 in front of Bravo cameras, but their journey down the aisle was far from harmonious. During their engagement, the two reality stars fought incessantly over money and their prenuptial agreement. In a new filing, Tucker made specific requests regarding their children and assets and questioned whether their prenup could actually be enforced.

On Wednesday, November 26, Tucker filed a response in court requesting primary custody of their two children, Blaze and Ace Tucker, claiming Burruss has been busy handling "out-of-state work obligations." According to Us Weekly, Tucker noted that Burruss' packed work schedule would continue to keep the Xscape singer away from their children "for at least the next several months."

In the filing, Tucker stated that he and Burruss have been working well together to reach a resolution, and expressed belief that their professional working relationship in this matter would continue. Tucker, however, said that if the pair were unable to reach an agreement, he would seek primary physical custody, joint legal custody, and final decision-making authority.

"[Burruss] having substantial time and meaningful access to the children," the filing reads. "[Tucker] wishes to make clear that he recognizes [Burruss] as a loving and capable parent and remains sincerely hopeful that prior and continued discussions between the parties will bring full resolution of all matters."

During Burruss and Tucker's 2014 Bravo wedding special, the pair bumped heads throughout the five-episode series over the details of their prenup. Tucker, admittedly, didn't want to sign a prenup, while Burruss was adamant that he sign.

In Tucker's recent filing, the father of two hinted that he was pressured into signing the legal document and noted his lawyers' absence. Tucker's lawyers said in court that the couple's prenuptial agreement "was presented to [Tucker], without [Tucker] having counsel, even though [Burruss'] then counsel had communicated previously with [Tucker's team] regarding a potential prenuptial agreement."

Their statement continued, "Despite that knowledge, [Burruss'] counsel presented the final agreement to [Tucker] for signature immediately before the wedding ceremony, without any notice to or consultation with [Tucker's team], who had been significantly engaged in the negotiation process."

Tucker's legal team said they were concerned about the environment in which their client signed the prenuptial agreement and questioned whether the document could still be enforced. "Nevertheless, [Tucker] remains committed to working in good faith to resolve this matter amicably and privately to the extent possible," they finished.

Tucker's filing also demands a "division of all marital assets, both real and personal, tangible and intangible, between the parties." Ultimately, he's requesting primary custody and potentially alimony if the court deems the prenup unenforceable.

Burruss Announced Divorce From Tucker Just After BravoCon 2025

Burruss first announced she was filing for divorce from Tucker after 11 years in November 2025, just after the third-ever BravoCon event concluded in Las Vegas. In her statement, Burruss acknowledged the new stage of life she was preparing to enter, noting that she is focused on her personal growth.

While receiving her Wifetime Achievement Award days before, Burruss praised Tucker for sticking by her side through thick and thin throughout their marriage. "You earned this award, too," she said.

Social media users have been sharing their thoughts on Tucker's latest filing, slamming the 52-year-old and accusing him of marrying Burruss solely for financial gain.

One user wrote that the only time "a man wants custody is for child support," later stating the "RHOA" fans knew Tucker "wasn't ish."
