Alec Baldwin’s 'Rust' Nightmare Isn’t Over As The Gun Supplier Fights Back

Nearly four years after the tragic shooting on the set of “Rust,” which claimed a life, Alec Baldwin is once again facing legal trouble connected to the tragedy.

The actor, who thought his long legal ordeal had ended after his criminal case was dismissed, is now being sued by the movie’s gun supplier.

Seth Kenney, who owns PDQ Arm & Prop, LLC, filed a new complaint in New Mexico accusing Baldwin and other producers of mishandling property, ignoring safety protocols, and using him as a scapegoat.

In his lawsuit, filed on October 22, Kenney claimed that Alec Baldwin and the “Rust” production team misused his company’s rental weapons and failed to pay for them.

He accused the producers of showing “serious lapses in judgment” by breaking safety agreements and creating a “scapegoat smear campaign” to protect themselves.

According to the filing, Kenney’s firearm rental property was in good working order and was provided “under the provisions of the strict safety guidelines and practices.”

However, he alleged that the crew violated the rental agreement by allowing the loading, illegal concealment, and discharge of a live round of ammunition.

Kenney, who supplied prop guns and blanks to the Western, said Baldwin and others did not follow the safety rules that were clearly outlined when they rented the equipment.

Kenney’s filing also featured claims that the incident destroyed his reputation in Hollywood and left him struggling to recover emotionally and financially.

According to him, he suffered terrible financial damage and emotional trauma, including “ruinous financial losses, injury to reputation within the film community and public at large, severe emotional distress, and significant loss of past, present and future financial income.”

In an interview with Variety, the supplier described the situation as devastating. “It’s not a matter of saving face. There’s nothing left to lose. This whole thing has been sh-t and I have been the scapegoat.”

The incident in question happened in October 2021 when a gun Baldwin was holding discharged during rehearsals, striking Halyna Hutchins and the film’s writer-director, Joel Souza.

The tragedy brought global attention and years of investigations, with Kenney serving as a key witness in two major trials.

After years of legal battles, Baldwin’s involuntary manslaughter trial ended in July 2024 when a judge dismissed the case with prejudice.

His lawyers successfully argued that prosecutors had withheld evidence, making the case impossible to continue.

Meanwhile, “Rust” armorer Hannah Gutierrez-Reed was convicted of involuntary manslaughter in March 2024 and served 14 months in prison.

Over a year after the case was dismissed, Kenney says he has been unable to find work in the industry since.

“I’ve gotta say my piece,” he told Variety. “I do have that opportunity to say, ‘Here’s what really went on with a lot of things.’”

Baldwin’s Own Lawsuit Against Officials Was Dismissed

Kenney’s filing against Alec Baldwin comes months after the film producer’s lawsuit was dismissed in New Mexico.

As The Blast reported in July, court documents showed that Baldwin’s case against several prosecutors and law enforcement officials was dropped after no "significant action” occurred for more than 180 days.

The 67-year-old had sued for “malicious abuse of process, intentional spoliation of evidence, defamation, and violation of the New Mexico Civil Rights Act.”

He alleged that prosecutors were “blinded by their desire to convict” him for all the wrong reasons, and at any cost.

In his filing, Baldwin said a crew member handed him the gun on the day of the shooting and yelled “cold gun” to assure him and others nearby that it contained only dummy rounds.

“The prop fired a live round that killed Hutchins,” his complaint stated.

Baldwin’s attorneys accused “certain defendants” of hiding evidence and lying on the stand to make him the “scapegoat” for Hutchins’ death.

A month before his lawsuit was dismissed, The Blast reported that producers reached a settlement with three crew members who had sued for emotional distress, claiming safety rules were ignored.

The plaintiffs included Ross Addiego, a crew member who witnessed the fatal shooting during rehearsals.

Although the producers, including Alec Baldwin, denied the claims, they agreed to settle the matter privately, and the terms were not disclosed.

Prosecutors had previously accused Gutierrez-Reed of bringing live ammunition to the set and failing to follow proper gun safety.

Baldwin was indicted for involuntary manslaughter in January 2024, but the charge was dropped six months later.

Even though filming for “Rust” was completed in Montana and the film was released in theaters in May 2024, the controversy continues.
