The stuntwoman's lawyer noted that it is rather discomforting to see Costner's team continue to manipulate and try to convince LaBella that her experience on set was different from her story.

"It's disturbing to see the defendants continue to 'mansplain' to Devyn what her own experience was on set. She has sworn under oath to the truth and has produced contemporaneous proof to back it up," the attorney noted.

The lawyer emphasized that LaBella's account has remained unchanged since she first reported the incident to the production team in 2023, immediately after it happened.

According to TMZ, Costner's lawyers have stated that LaBella's lawsuit must be dismissed because she basically admitted that she was untruthful in the initial filing.

The actor's camp clarified in their latest filing that LaBella had claimed that she was spontaneously pushed to film the rape scene without a prior discussion.

Now, Costner's team has spotted the inconsistency, noting that she is now claiming a stunt coordinator, Wade Allen, met with her in advance to explain what the scene entailed.

LaBella also reportedly previously admitted to having optimum knowledge of the scene and everything that would go down. The lawyers claimed she knew she would be lying down in a covered wagon and that her dress would be pushed up to her knees.

The actor's lawyers are now using the alleged inconsistency in LaBella's story to push the request that her lawsuit be trashed.

If there is one thing Costner has been consistent about, it is his continuous pleas that the court throw out the case. In reacting to one of her amended filings, Costner's team noted that about 12 eyewitnesses were willing to dispute LaBella's allegations and prove that they were all made up.

As stated on The Blast, his lawyer, Marty Singer, emphasized Costner's innocence, adding that he is ready to be completely open about what happened behind the scenes during the filming of "Horizon 2."

LaBella explained in the lawsuit that during the tugging and pulling on set for the rape scene, her undergarments and pantaloons were forcefully torn and ripped.

She added in the suit that she also struggled to find her rhythm under the pressing weight of actor Roger Ivens after he pinned her down and placed his hands on her privates. According to Costner's claims, every piece of clothing on LaBella was intact.

LaBella stated that the incident, which happened right when she was menstruating, escalated the whole situation, leaving her psychologically and emotionally tortured.

The Blast shared that the stuntwoman claimed that Ivens' hands resting right above her vagina between takes also makes the experience twice as chaotic. After the scene was done, LaBella contended that she was left an emotional wreck in the G-wagon, feeling "shock," "embarrassment," and "humiliation" all at once.

LaBella had reportedly communicated how bad she felt about the whole thing to the set intimacy coordinator, a proof she attached to her lawsuit. The stuntwoman also wondered why the intimacy coordinator was absent during such a sensitive moment.

"I wanted to discuss yesterday's abomination when we both have a chance ... I was put in a really wrong position and it's really affected me," LaBella allegedly detailed in the text.
