Diddy will have to choose another strategy to get out of his ongoing court battle.

The judge in charge of the rapper's case has declined his motion for a mistrial in his ongoing case, which has seen an increasing number of controversial testimonies from various witnesses against the mogul.

Diddy was arrested on September 16, 2024, in New York. The arrest came after a federal indictment and raids on two of his homes in Los Angeles and Miami.

The judge in Diddy's federal racketeering and sex trafficking trial, Judge Arun Subramanian, has denied the request for a mistrial. This decision came as the trial entered its 20th day, following controversial testimony from Bryana Bongolan, a friend of Cassie.

Bongolan claimed that Diddy once dangled her over the edge of a 17th-floor balcony at Cassie's Los Angeles apartment in September 2016. Cassie herself had previously testified that she witnessed this incident, but Diddy's defense team argued that it was untrue.

According to them, the text messages between Cassie and Diddy's former chief of staff, Kristina Khorram, contradicted her claim. As shared by TMZ, in one message, Cassie suggested she had not actually seen the incident, stating, "I just found out some crazy sh-t."

This discrepancy led Diddy's lawyers to file for a mistrial, alleging that the prosecution had presented false testimony. They also challenged the authenticity of photos that purportedly showed injuries Bongolan sustained during the balcony incident.

According to his lawyers, the metadata from the images indicated they were taken when Diddy was on the East Coast, far from the alleged scene in California. 

Although prosecutors have yet to respond to Diddy's motion for a mistrial, they clarified in court that Cassie's texts seemed to suggest the incident occurred later, around September 29 or 30, 2016.

During the proceedings, Judge Subramanian acknowledged Bongolan's past struggles with substance abuse, stating, "Thank God she's sober," and ultimately chose not to interpret her testimony as perjury.

Last week, The Blast shared that Judge Subramanian called the mogul to order during his federal trial on Thursday. The court official reportedly called the judge's attention to Diddy's conduct, prompting his comments.

The judge then proceeded to condemn Diddy for displaying unacceptable behavior and threatened to remove him from the premises if the act continued.

Subramanian also strongly criticized the rapper's legal team over his inappropriate interactions with jury members. He emphasized that there should be no facial expressions directed at the jury, pointing out that Diddy had been nodding vigorously during questioning.

The judge deemed this behavior "unacceptable" and warned that any further attempts to engage with the jury could lead to serious consequences, such as "giving an instruction to the jury" or potentially excluding Diddy from the courtroom.

In response, Diddy's attorney assured the judge that such interactions would not occur again.

Diddy's trial has seen the attendance of his children, including his 18-year-old twin daughters, which has raised some eyebrows. Aubrey O'Day, the former lead singer of Diddy's girl group, Danity Kane, and also one of his accusers, expressed her concerns about this decision in a May 2025 interview. 

She questioned why any father would want his children to witness the graphic testimony detailing disturbing elements of his alleged behavior. 

"I don't know any father that would want their children to sit through testimony about how much their daddy liked to watch people [get] lubricated, f-cking, getting pissed on and urinated in their mouths, having his girlfriend come in the other room and rub their c-m all over his nipples," the singer said.

O'Day also suggested that the children's presence in court could also be a strategic move to elicit sympathy from the jury. She remarked on how the presence of his children at the trial creates a strong visual impression meant to benefit the defense.

As reported by The Blast, during a recent Q&A session in the Oval Office, President Trump addressed questions about his past friendship with Diddy. Their friendship became the topic of discussion after Trump considered pardons for various incarcerated celebrities like reality stars Todd and Julie Chrisley.

Although Trump mentioned that he and Diddy have not maintained a relationship in recent years, he expressed a willingness to consider clemency for the rapper. POTUS also mentioned that it would be under certain conditions, if he were found guilty, and if he believed Diddy was being "mistreated."

Trump explained that their friendship deteriorated when he entered politics, but he emphasized that their estrangement would not influence his decision-making regarding a potential pardon.

He clarified that he would need to assess the situation and examine the facts before making any final conclusions about Diddy's case.
