Leah McSweeney has scored a legal victory, as a judge has ruled that her lawsuit against Bravo, Andy Cohen, and other producers will proceed to court. 

McSweeney is set to be the first housewife to have her case argued in court, potentially paving the way for future legal challenges against Bravo and its practices.

Leah McSweeney made waves by accusing Bravo of exploiting her alcohol addiction for the sake of ratings, along with creating a toxic work environment on "The Real Housewives of New York City."

McSweeney's legal battle with Bravo is far from over, as a judge ruled that she can continue pursuing her lawsuit despite some parts being dismissed. 

The judge's 100-page ruling allows McSweeney to keep the heart of her case intact, particularly her claims that the network's "producers directly coerced and harassed her based on her addiction."

According to her, producers allegedly taunted her about her alcohol use, undermined her sobriety with demeaning comments, and directed cast members to mock her substance abuse problems. 

Page Six reports that McSweeney can also proceed with her claim about the producers' broken promises regarding her request to attend an AA meeting while filming "Ultimate Girls Trip."

Judge Lewis Liman noted, "Her request to attend an AA meeting could have been accommodated without unreasonable hardship or expense."

Judge Sides With Producers On Drinking Controversy

Although allowing her case to proceed, Judge Liman also sided with the producers' oral arguments. The producers' argument from November was that they had a First Amendment right to encourage drinking on the show.

Their reason is that "it is not incidental but central to the show's message that the drinking activities it portrays are authentic and genuine." The case now shifts into a more contentious phase, with both sides poised to exchange private records, texts, and emails and request under-oath interviews.

McSweeney's attorney, Gary Adelman, praised the judge's decision while acknowledging disagreements with some aspects of the ruling. He emphasized:

"While we disagree with his findings on the minor claims and will certainly be filing an amended complaint to address his questions, this decision is not a scorecard, it was an affirmation that there are serious claims and that they will proceed in Court."

McSweeney's legal battle against Bravo made a significant stride as a judge set a hearing date for October 30, 2024, where both parties were expected to present their arguments in a Downtown New York courthouse. 

The Blast reported that the hearing was set to address Bravo and Andy Cohen's motion to dismiss McSweeney's lawsuit.

Before the hearing, McSweeney's attorney was granted permission to search for evidence in the defendants' private records and devices, with reports that this granted the lawyer access to critical files for the case.

This hearing marked a historic moment in the world of Housewives, as it was the first time a cast member or former star had taken Bravo to court in such a manner.

McSweeney's lawsuit against Bravo and Cohen revealed explosive claims about the "Real Housewives" franchise. 

The 42-year-old described how producers, fully aware of her battles, allegedly tried to manipulate her into drinking, succeeding once but failing a second time when she refused to give in.

McSweeney accused the network of turning her struggles into a spectacle for profit. In her allegations, McSweeney also targeted Cohen, claiming he participated in illegal activities with the Housewives cast, including alleged cocaine use.

Last year, Cohen and Bravo swiftly denied her claims and pushed for the case to be dismissed. 

The "Watch What Happens Live!" host's legal team went on the offensive, threatening McSweeney with a defamation lawsuit over her allegations, particularly the claim that Cohen used cocaine with cast members of "Real Housewives."

His lawyers rejected the allegations, calling them "categorically false," adding, "The absence of any reasonable basis to make such allegations is confirmed by your pleading itself."

Cohen's legal team emphasized that her claims lacked any credible evidence and pointed out that she had failed to provide specifics. They argued the allegations were baseless and not supported by facts. 

With this ruling, Leah McSweeney's lawsuit is setting the stage for a legal showdown that could redefine the future of reality TV.
