Actor Alec Baldwin will not be facing any criminal consequences for his role in the death of “Rust” cinematographer Halyna Hutchins, but that doesn’t mean that her mother, father, and sister have given up. Instead, they intend to make him pay in civil court.

The “30 Rock” actor was holding a gun on the set of the Western film when it went off, striking and killing Hutchins. Although “Rust” armorer Hannah Gutierrez-Reed was sentenced to 18 months behind bars for involuntary manslaughter, a judge dismissed the charges against Baldwin with prejudice on the third day of witness testimony after she decided that the prosecution had failed to disclose crucial evidence to Baldwin’s legal team.

In a brief statement released after two episodes of TLC’s “The Baldwins” reality series, Halyna Hutchins’ family attorney, Gloria Allred, took Baldwin’s family to task for allegedly profiting from her death.

Allred claims that the show "celebrates Mr. Baldwin’s joy of being with his children while ignoring the fact that Alec Baldwin took a child away from her parents. That is the painful and actual reality with which Halyna’s parents and sister live each and every day." She also insists that Baldwin never apologized to them for the fatal shooting, which occurred in October 2021.

Although “The Baldwins” shows his wife, Hilaria Baldwin, and his seven children grappling with the aftermath of the “Rust” shooting and trial, Allred says that the family is displeased by how little they actually show the suffering of Hutchins’ family.

“Halyna lost her life in the most unthinkable tragedy, a son lost his mom. We are going to feel and carry this pain forever. This will be a part of our family’s story,” Allred said in a statement obtained by TMZ.

Allred goes on to say that the TLC reality series does not mention the “family story” of her parents and sister, who are the ones that will have to live with her loss.

The "Supercell" actor will be deposed in May at the law firm's New York office, according to a filing obtained by The Hollywood Reporter. “It is long overdue for him to testify under oath about what really happened that caused the death,” Allred stated.

In the first episode of their TLC reality series, “The Baldwins,” Hilaria opened up on the impact that the “Rust” shooting had on their seven children.

"We're blessed to have them, and they give us joy. And at the same time, we want to make sure that they're always our children, and that they can be children, and that they don't bear the burden of having to carry us," she said in the premiere, in comments transcribed by Peoplemagazine. "When something bad happens, there is a fire, and your job is to try not to let the fire spread. But I wanted to put as much as I could a fireproof barrier around my kids."

"It's extraordinarily difficult when you feel so horrible inside and so scared and confused because you have this constant nausea here, the panic, the inability to sleep," she continued. "This trial is happening, and Alec could go to prison.”

In the same episode, she also spoke openly about Hutchins’ family, focusing on her husband and son.

"Life will forever be different. Halyna lost her life in the most unthinkable tragedy, a son lost his mom," Hilaria said. "We are going to feel and carry this pain forever. This will be a part of our family story.”

“I look at the kids, and I see how hard we're trying to create happy for them, even if we're masking stuff for ourselves," she continued. "I know that what we're going through is maybe unique, but every family goes through hard times, and that's something that we can feel a community of support, knowing that the best that we can do is do our best and try to make our kids happy, and so that's what we're doing.”

Their Daughter Carmen Struggled With Possibly Losing Her Dad

While Hutchins’ son is grappling with how to grow up without a mother, the Baldwins’ oldest daughter, Carmen, 11, struggled with potentially losing her father, who was facing 18 months behind bars if convicted of involuntary manslaughter. In the show’s second episode, Hilaria explained that Carmen could no longer sleep alone and had to move her bed into her brother’s room in order to feel less isolated.

"When Alec was charged the first time, Carmen would not be alone in a room for months. We had to move a bed into sleeping with the boys," Hilaria said in a confessional. "She has a fear of: 'Is our family going to be torn apart?' So with that, there is an awareness of what's going on."

"Carmen asked me last night. She said, 'When Daddy goes to New Mexico, do I have to say goodbye to him?' " she continued, becoming emotional as she spoke. "'Like I have to say goodbye to him for a long time? Should I say goodbye to him in a special way, like I won't see him for a long time because they're trying to take my daddy from me?'"

"And I said, 'Yeah, you should.' And she just lost it," she added. "So you know, we've never even been away from each other for three weeks. So if he goes there, that's never even happened."
