Sean "Diddy" Combs' lawyers filed a new document on Tuesday asking the judge to dismiss the third charge that the U.S. attorney's office brought on him.
Diddy is being charged with sex trafficking, racketeering, and transportation to engage in prostitution. However, the embattled rapper argues that the feds are pursuing their third count against him with a "racist" law because he's a successful black man.
Sean "Diddy" Combs' attorney has maintained his innocence on all counts amid the increased number of sexual assault lawsuits he's been embroiled in since his September arrest.
Diddy Believes Feds Are Trying To Use 'Racist' Law To Nail Him

The rapper has come out swinging against federal authorities, accusing them of attempting to take him down using an old and "racist" law.
According to TMZ, Diddy's attorneys were in court on Tuesday, where they filed documents seeking to dismiss count 3 of his charges, which accuses him of "transportation to engage in prostitution," also known as the Mann Act.
The news outlet reports that Diddy believes it was the same ploy the government used to nail rock 'n roll legend Chuck Berry and boxer Jack Johnson. The rapper also pointed out that it was not a coincidence that they were both successful black men, just like him.
He wrote: "No other person, and certainly no white person, has ever been prosecuted under the White-Slave Traffic Act for hiring male escorts from another State."
Diddy Uses Former New York Governor As An Example In His Argument

Diddy's attorneys have maintained that he's innocent of the charges, and their latest move suggests he's accusing the government of only charging him because he's black.
The U.S. Attorney's office slapped the third count on him for allegedly hiring male sex workers to attend his sex parties, also known as "freak offs."
However, the "Finna Get Loose" rapper believes "he is being prosecuted for conduct that regularly goes unpunished."
He brought up former New York Governor Eliot Spitzer, who was pretty much involved in the same escort scandal but was only forced to resign in 2008.
Diddy noted that four people running the escort service in Spitzer's case were charged under the Mann Act, but Spitzer himself was not.
The embattled rapper's attorneys say prosecutors have built their case "based primarily on allegations that Mr. Combs and two of his longtime girlfriends sometimes brought a third party -- a male escort -- into their sexual relationship."
They went on to claim that hiring escorts is "common and indeed widely accepted in American culture today," adding that the business is a legit one operating "out in the open."
The Rapper's Lawyers Maintain His Innocence

The "Bad Boy For Life" rapper remains incarcerated at the notorious Metropolitan Detention Center in New York ahead of his trial on May 5.
He has attempted to get bail but was denied multiple times due to him being a "flight risk," among other reasons given by a judge.
Recently, a sexual assault lawsuit filed by an anonymous woman was dismissed with prejudice. The person alleged that Diddy and Jay-Z raped her when she was only 13 years old at a 2000 MTV VMAs party.
Responding to the dismissal, his legal team issued a statement maintaining his innocence.
"For months, we have seen case after case filed by individuals hiding behind anonymity, pushed forward by an attorney more focused on media headlines than legal merit. Just like this claim, the others will fall apart because there is no truth to them," the statement said.
It continued: "This is just the first of many that will not hold up in a court of law."
Diddy Sues NBC Universal, Ample, And Peacock

Diddy recently filed a $100 million defamation lawsuit against NBCUniversal, Peacock TV, and Ample Entertainment for defamatory statements published in the documentary "Diddy: The Making of a Bad Boy."
The documentary featured several former associates and acquaintances of the rapper, including Al B. Sure and Rodney Jones.
However, Diddy alleged that the media companies "falsely, recklessly, and maliciously" made damning allegations against him, including serial murder and sex trafficking, amongst others.
His lawyer, Erica Wolff, issued a statement following the filing, claiming that these media companies "made a conscious decision to line their own pockets at the expense of truth, decency, and basic standards of professional journalism," per Variety.
Diddy's Lawyers Claim Media Companies Are 'Exploiting The Trust Of Their Audience'

In Wolff's statement, she further noted that the various exposés on Diddy were filled with "lies."
She said, "Grossly exploiting the trust of their audience and racing to outdo their competition for the most salacious Diddy exposé, Defendants maliciously and recklessly broadcast outrageous lies in 'Diddy: The Making of a Bad Boy.'"
Wolff said that the defendants accused Diddy of "horrible crimes " even if they knew there was "no evidence" to support their claims, adding that they only sought to "capitalize on the public's appetite for scandal without any regard for the truth and at the expense of Mr. Combs's right to a fair trial."
"Mr. Combs brings this lawsuit to hold Defendants accountable for the extraordinary damage their reckless statements have caused," the statement noted.
