Jessica Alba is moving forward with her divorce proceedings as reports suggest she has taken a significant step toward ending her marriage to Cash Warren.
Although the estranged couple has kept their relationship friendly for the sake of their kids, Alba has retained a divorce attorney, suggesting she will not give their split a second thought.
Experts have already estimated that Cash Warren could receive a $2 million yearly payout from his divorce from Jessica Alba, regardless of whether they signed a prenup.
Jessica Alba Retains Divorce Attorney
Alba has retained a divorce lawyer after splitting from Cash Warren. Earlier this month, reports suggested that the couple, who married in 2008 and have three children together, are heading for divorce.
According to People Magazine, a source who revealed the actress' latest legal move said the pair are still "friends and all about the kids" but that it'll be hard for them not to formally split because it's been "hard to keep the spark" in their marriage.
"No matter what's going on right now, it seems they will remain close," the insider shared. "If they're filing for divorce, it's not because of some hateful drama. They still look happy together. Jess has mentioned over the years though that it's hard to keep the spark."
Alba and Warren seemingly sheathed their swords as they put up a united front to celebrate their son Hayes's 7th birthday earlier in January.
The Estranged Couple Will File For Divorce 'Soon'
According to US Weekly, a source explained that the estranged couple plans to officially file for divorce "soon," though the proceeding seems to have been stalled by the ongoing L.A. fires.
"Cash has been slowly moving things out of their house but since the fires, they have been spending more time under one roof as a family," the source said. "They are being there for each other right now as it is a very stressful time."
The insider also noted that the "Fantastic Four" actress will keep their Beverly Hills home, adding they are "working it all out behind the scenes."
"They have had many ups and downs as any marriage would after being together for so many years," the insider continued, adding that Alba and Warren "have tried therapy and have worked out past issues over the years."
Despite their efforts to make it work, the source said that "the romance was gone between them" and that "there were trust issues in the past, which led to many arguments."
Cash Warren Could Walk Away With $2M Annual Payout
Ahead of the couple's official filing, it's been revealed that Warren could walk out of the marriage a lot richer because of the large wealth disparity between him and Alba.
While Alba co-founded The Honest Company, valued at $609 million and once reportedly had a value of over $1 billion, Warren is a producer who does not appear to have worked in the industry since 2015.
Legal expert and powerhouse certified family law specialist Goldie Schon told The Sun that he could walk away with a $2 million yearly payout from Alba as the "Trigger Warning" actress has to pay much more than child support.
Schon noted that Warren's chances of leaving their 16-year marriage richer wouldn't be affected by the presence or absence of a prenup.
"Even if there is a prenup, and she gets to keep what is hers, therefore, the Honest Company, which is quite lucrative, that will not stop the issue of spousal support," Schon told the news outlet.
She continued, "We have evolved when it comes to prenuptial agreements, and we've had some very large cases, historically, that have caused prenuptial agreements to not be able to terminate spousal support between couples that are about to marry."
The Actress Once Branded Her Husband Her 'Roommate'
Alba and Warren's marital issues may have been brewing for a long while, as an old clip of her saying they were more like "roommates" resurfaced.
The actress made the remarks about her marriage in a July 2021 appearance on Katherine Schwarzenegger's Instagram show, "Before, During and After Baby."
"It's all rosy for two and a half years. But then after that, you become roommates," Alba shared, per Page Six. "You're just going through the motions. You have the responsibilities. It's a lot of, like, checking the boxes, right?"
Elsewhere in the conversation, the "Dark Angel" alum admitted that she often took their partnership for granted.
"We have, like, obviously the friendship, the comfort of, like, 'you're not going anywhere,' and so sometimes you don't treat those people the best, right?" Alba said. "You don't consider their feelings in the way that you would consider other people's feelings, So that is something that I think is a constant one to work on."
Jessica Alba Makes Rare Sighting Amid Divorce News
Alba was recently seen for the first time since her reported separation from Warren surfaced. According to photos published by Page Six, she was seen out and about in L.A. on Monday, Jan. 13, shopping at Erewhon supermarket and heading to a park in Hollywood.
Just like most of her recent public outings, she was without her wedding ring for the outing. Reports suggest she has been focusing on relief efforts in L.A. as wildfires continue to devastate the city and many of its surrounding communities.
On Wednesday, Jan. 15, she shared on Instagram that she "had the privilege of spending the afternoon at @baby2baby" on Jan. 14, "with so many beautiful souls, packing fire relief hygiene kits for children," adding, "This Friday, 750 kits will be distributed to kids who have either been evacuated or lost their homes in the Altadena fire."
