Kyle Richards' Estranged Husband Slammed For Move To Dismiss Unnecessary Loans Lawsuit

Kyle Richards' estranged husband, Mauricio Umansky's nemesis, is demanding serious accountability from him amid his PPP loan lawsuit.
The entrepreneur and his real estate company are involved in a $3.5 million PPP loan mismanagement controversy, and another company criticizes him for trying to water it down.
Mauricio Umansky and his company, The Agency, were accused of reportedly acquiring millions of unnecessary loans during the worldwide pandemic.
Kyle Richards' Estranged Husband's Accuser Claimed The Funds Borrowed Were Misappropriated
A real estate company, Relator LLC, criticized Umansky and his company for attempting to ignore his federal lawsuit. According to Relator LLC's attorney, the case must be pursuedto the end to grant justice to everyone involved.
The lawyer also accused Umansky and his company of deflecting from the actual situation and claiming that "the [first amended complaint] contains insufficient allegations – not on the facts alleged – but only on how [Relator LLC] came to realize the facts."
The company's lawyer continued that the "defendants' entire motion is based not on the assertion that Plaintiff is wrong, but rather that [Relator LLC] does not have direct knowledge of the fraud."
Per In Touch, Relator LLC reiterated that Mauricio and The Agency did not need to acquire the loan as his real estate company recorded profits and impressive turnovers. The lawyer for Relator LLC added:
"Given that Holdco's subsidiaries Umro and The Agency had booming business of $6 billion of sales in 2020 and $6.5 billion in sales in 2021, Defendants' threshold for economic necessity is a high bar that they cannot overcome on a motion to dismiss."
Mauricio Umansky Faulted Relator LLC's Credibility To Question His Motives
The Bravo star did not have any of Relator LLC's accusations against his venture, and he responded to that effect.
The Blast reported that Umansky stated that Relator LLC was making unfounded claims about him and his real estate company, describing the company as a "third party corporation formed by lawyers for a single purpose — to 'whistle blow.'"
He explained that the corporation was only attacking businesses it had no relation with, including his establishment. His argument read:
"Relator makes the specious claim that Defendants falsified information and certifications on its applications for Paycheck Protection Program ('PPP') loans in 2020 and 2021 through guesswork, speculation, and contrived facts."
Umansky described Relator's allegations as cooked up facts as the company "is in no way connected to Defendants: Relator was not previously employed by Defendants nor is it otherwise affiliated with Defendants."
He concluded that the company cannot "ascertain or know firsthand the facts surrounding The Agency's application for PPP loans in the shadow of the COVID-19 global pandemic due to their questionable proximity to the case."
Umansky Accused The Plaintiff Of Conducting Mediocre Research About His Firm And The Loan
The TV star continued in the filing that Relator LLC released statements about the real estate agent and his firm using "publicly available gross sales figures and PPP loan information."
"Relator makes conclusory statements about The Agency's financial position that are illogical and unfounded. Relator improperly equates gross sales figures with profits and liquidity," the real estate guru argued.
He accused the company of speculating about what percentage of real estate sales The Agency would have received. Umansky added that they then affirmed that his company was falsifying payroll numbers without possessing any concrete information confirming their narrative.
Relator LLC Filed Their Lawsuit Against The Father-Of-Three In 2023
The court decided to unseal Relator LLC's allegations in August 2024, revealing that the company initially filed the petition in July 2023.
The documents identified Umansky, his business partner William "Billy" Rose, and their real estate company, The Agency, as conspiring to embezzle loans intended for struggling businesses.
"This is a case about greed during a national health emergency," the plaintiff noted in the filing. According to Relator LLC, Umansky had applied to receive two Payroll Protection Program (PPP) and CARES Act loans during the COVID-19 pandemic via The Agency.
The filing argued that the loan schemes were not created to "bolster or preserve the profits of a business that had sufficient funds available to pay its employees." Instead, they were established to salvage the employment status of workers by businesses that could not pay them.

Ignorant of the fate awaiting him, the reality star reportedly bought an expensive luxury condo in West Hollywood months before Relator LLC came out guns blazing.
Umansky's new home was reportedly in the same building where Matt Damon bought his $8.6 million unit. A source close to Umansky explained that his relocation did not surprise him since he was separated from Richards.
They claimed Umansky and Richards "have been living separately for the last few months, and he's been staying there." The insider added that the duo's frequent travels also influenced their decision not to coexist inside the same property.
