Jay-Z's Lawyer Argues For Dismissal Of Rape Accuser's Lawsuit Citing Legal Loophole

Jay-Z's attorney, Alex Spiro, has shared new reasons why the rape lawsuit against the rapper should be dismissed.
He claimed that several details about the case were glossed over and pointed to issues with the timing of the events in question, which he believes prevent the legal statute the woman is suing under from being applicable to the case.
Previously, the presiding judge of the rape case ruled that the alleged Jay-Z and Sean "Diddy" Combs victim could remain anonymous for the time being.
Why Jay-Z's Attorney Believes Rape Lawsuit Should Be Dismissed
Following a failed attempt to have Jay-Z's rape case dismissed, the rapper's lawyer, Alex Spiro, has presented new reasons why the case should be thrown out.
In legal documents obtained by the Daily Mail, Spiro argued that the legal statute under which the woman is suing had not been implemented until three months after the alleged sexual incident occurred.
As a result, he claimed, the statute "can't be applied retroactively" to the rapper, who vehemently denied the accusations against him by the Jane Doe.
Spiro also highlighted the accuser's claim that she was living in Rochester at the time of the incident and was driven approximately 20 minutes from her location to the party in New York City.
He argued that if this timeline were accurate, the 20-minute travel distance indicates the alleged incident did not occur in New York City, which should invalidate the lawsuit on jurisdictional grounds.
The Rapper's Lawyer Claims The Suit Was Filed Outside The Statute Of Limitations
In the docs, Spiro went on to say that the suit from the rape accuser should also be dismissed on the grounds that it was filed outside the statute of limitations.
He stated that any legal action stemming from the alleged assault should have been initiated before August 2021, when the statute of limitations had not yet expired.
Citing these reasons, Spiro announced his intention to file a motion to dismiss the case despite losing earlier attempts to have it dismissed due to inconsistencies in the accuser's statements.
In response, the accuser's lawyer, Tony Buzbee, issued a statement on Monday, dismissing Spiro's claims as "technical arguments" and expressing confidence in the strength of the case despite the new legal maneuvers.
He said, per TMZ, "The law is clearly on our side and the side of alleged victims. The law is well settled that we are correct."
Judge Recently Criticized Jay-Z's Lawyer's 'Relentless Filing Of Combative Motions'
Previously, presiding judge Analisa Torres slammed the rapper's attorney's repeated maneuvers to fast-track the suit and expressed disapproval over his use of inflammatory language in addressing the accuser in previous filings.
"Carter's lawyer's relentless filing of combative motions containing inflammatory language and ad hominem attacks is inappropriate, a waste of judicial resources, and a tactic unlikely to benefit his client," Torres said in her five-page ruling, per the Daily Mail.
She added, "The Court will not fast-track the judicial process merely because counsel demands it."
Torress also ruled that Jay-Z's rape accuser's anonymity would be preserved but may be revealed at a later date to allow the rapper's attorney to collect information to prepare for trial.
Jay-Z Sued Rape Accuser's Lawyer For Defamation
Alongside fending off the rape allegations, Jay-Z is involved in a legal tussle with his accuser's lawyer, Tony Buzbee.
According to the Daily Mail, he had previously filed an extortion claim against the Texas-based attorney but recently amended the suit to include a defamation claim.
In the amended filing, the Roc Nation founder's attorneys accused Buzbee of launching a defamation campaign against Jay-Z, citing media threats made to "anyone who may have ever come into contact with [Sean 'Diddy'] Combs," who at the time was facing multiple civil lawsuits from Buzbee.
They also presented evidence of Buzbee liking posts suggesting the rapper's involvement in Diddy's alleged sexual assaults and referenced a December 10 TMZ article in which Buzbee discussed the possibility of filing a criminal complaint against Jay-Z.
Regarding the latter, Jay-Z's lawyers claimed that Buzbee intended "to leave the public with one unavoidable conclusion: that Mr. Carter was facing imminent criminal prosecution for rape."
They added, "These were no idle comments. This is defamation per se because he directly and falsely accused Mr. Carter of committing the horrendous criminal act of rape."
Tony Buzbee Claims His Client Never Demanded A Penny From The Rapper
In a statement to TMZ, Buzbee responded to Jay-Z's lengthy remarks regarding being named in a lawsuit filed by an alleged victim he is representing.
The attorney told the outlet that the rapper had "previously denied being the one who sued me and my firm," referencing an extortion suit that was filed against him by a person who described himself as a "high-profile individual."
Buzbee also shared that the Roc Nation founder had tried to hide that he was the one who filed the "frivolous case" by using a "pseudonym" in the suit.
The lawyer then defended himself, saying that Jay-Z failed to mention that the "demand letter," which the rapper claimed was a "blackmail attempt," did not include any discussions about money.
Buzbee told the news outlet: "What [Jay-Z] fails to say in his recent statement is my firm sent his lawyer a demand letter on behalf of an alleged victim, and that victim never demanded a penny from him."
