Former powerhouse attorney Tom Girardi is fighting multiple legal battles, and the estranged husband of “Real Housewives of Beverly Hills” star Erika Jayne is apparently in such bad shape that he cannot begin to comprehend the situation.
The Blast obtained new legal documents filed this week in the ongoing conservatorship of Girardi after his brother, Robert Girardi, made a move to become the conservator of both Tom and his estate.
The need for a conservator was especially important for 82-year-old Girardi – who was recently diagnosed with late-onset Alzheimer’s – as he is also dealing with a divorce, bankruptcy, and a long list of civil lawsuits from former clients who claim they were cheated out of millions of dollars in settlements.
The new documents were filed in L.A. County Superior Court by Tom Girardi’s court-appointed attorney, who submitted a report on his interactions with Girardi, as well as his feelings on whether Robert Girardi should become the conservator over his brother.
According to the report, the attorney stated that:
“Mr. Girardi could not fully comprehend the nature of the proceedings.”
He added that although Girardi could not understand exactly why he was being placed under a conservatorship, he had no objections to his brother “taking care of him and managing his finances.”
The attorney also noted that Girardi only answered in simple words, basically just saying “yes” to the questions he was asked about his brother taking over.
“I was of the professional opinion that he could not fully understand, comprehend nor
appreciate the nature of the [court-appointed attorney] disclosures albeit he had no objection to Robert becoming his conservator,” the attorney wrote.
Many have been questioning the timing of Tom Girardi’s diagnosis of late-onset Alzheimer’s as he is facing millions of dollars in damages with all the lawsuits and piling up and bankruptcy.
Even the divorce with “Real Housewives of Beverly Hills” star Erika Jayne has been looked at cross by fans, as some believe the separation is just a shelter to stuff the Bravo star with assets and keep them safe from the looming payouts.
However, the court documents reveal Girardi’s medical records states he “lacks the capacity to give informed medical consent and suffers from Dementia.”
